Fees for mining and use of environmental data in Vietnam from December 15, 2023

On October 31, 2023, the Minister of Finance issued Circular 65/2023/TT-BTC< /a> on fees for mining and use of environmental data and collection, transfer, management and use thereof.

Fees for mining and use of environmental data in Vietnam from December 15, 2023

From December 15, 2023, fees for mining and use of environmental data in Vietnam for agencies, organizations, and individuals requesting to provide environmental data will be implemented according to the Fee Schedule issued together with Circular 65/2023/TT-BTC.

For example, some fees are as follows:

- Documents on: environmental quality management; waste management and environmental improvement; biodiversity conservation; environmental communication; management of river basin, coastal and marine environment: 800,000 VND/report.
 
- Reports (period/year) on monitoring of: ambient air; surface water (rivers, lakes); coastal water; rainwater; underground water; sediments (river, seawater); soil environment: 800,000 VND/report.

- Data on results of monitoring of field air, noise, vibration: 21,000 VND/parameter

- Data on results of field monitoring of inland surface water: 17,000 VND/parameter

Management and use of fees for mining and use of environmental data in Vietnam

The fee collector may retain 70% of the total amount of collected fees in order to cover its costs of service provision and fee collection in accordance with regulations in Article 5 of Decree 120/2016/ND-CP. The remaining amount (30%) must be transferred to the state budget according to corresponding chapters and sub-items of the current State Budget Index.

The collector that is a state authority and is not allowed to retain collected fees to cover its operating costs as regulated in clause 1 Article 4 of Decree 120/2016/ND-CP must transfer 100% of the collected fees to the state budget.

The funding for service provision and fee collection shall be covered by the funds derived from state budget and included in that collector’s cost estimate under policies and levels of state budget expenditures.

More details can be found in Circular 65/2023/TT-BTC taking effect on December 15, 2023 and replacing Circular 22/2020/TT-BTC dated April 10, 2020.
