Law on the Organization of the National Assembly (Amended) 2025 was approved and takes effect from February 17, 2025, which includes amendments to the regulations on law-making and the amendment of laws by the National Assembly of Vietnam.
The regulations on lawmaking and amendment by the National Assembly are as follows:
(1) The National Assembly enacts laws to regulate the following contents:
- Organization and operation of the National Assembly, the President, the Government of Vietnam, the People's Courts, the People's Procuracy, the National Election Council, the State Audit, local governments, special administrative-economic units, and other agencies established by the National Assembly;
- Human rights, basic rights and obligations of citizens as prescribed by the Constitution; restriction of human rights and citizen rights; crimes and punishments; judicial procedures;
- Basic policies on economy, society, culture, education, science, technology, environment, national finance, and budget; regulations on taxes, orders, medals, and state honorary titles;
- Basic policies on national defense and security; ranks in the armed forces; regulations on emergency situations, and other special measures ensuring national defense and security;
- Basic foreign policy; diplomatic ranks; other state ranks;
- National and religious policies of the State;
- Referendum;
- Mechanism for protecting the Constitution;
- Other matters under the authority of the National Assembly as prescribed by the Constitution and law.
(2) Laws only define issues that are stable and have long-term value; specify contents related to human rights, citizen rights and obligations, judicial procedures, and issues with significant impact on social life, the relationship between State and citizens and society.
For state management contents in each field, new issues with developmental potential, issues without practical verification, laws shall define only the principles and policy orientations under the authority of the National Assembly to institutionalize the policies of the Communist Party; delegate authority to the Government of Vietnam and agencies within the state apparatus to further specify the provisions of the law and implement decentralization in accordance with the implementation capacity of each agency, organization, and local government at all levels, to promptly meet socio-economic development requirements in each period; generally, do not provide for contents on administrative procedures, professional, technical standards, and highly volatile contents.
(3) The National Assembly issues resolutions to regulate the following contents:
- Implement pilot programs for new policies under the decision-making authority of the National Assembly that differ from current law provisions;
- Temporarily suspend, adjust the effectiveness, or extend the applicability of all or part of laws or resolutions of the National Assembly to meet urgent socio-economic development requirements, ensure human rights, and citizen rights;
- Other matters decided by the National Assembly.
(4) Legislative construction within each term is determined and implemented according to the Legislative Orientation of the term of the National Assembly and the annual Legislative Program of the National Assembly.
(5) The process and procedures for drafting, considering, and enacting laws and resolutions by the National Assembly shall comply with the provisions of the Law on Promulgation of Legal Documents.
