On January 10, 2024, the Government of Vietnam issued a Decree 02/2024/ND-CP on Electrical power works as public property being transferred to Vietnam Electricity.
Regulations on electrical works being public assets transferred to Vietnam Electricity according to the provisions of Decree 02/2024/ND-CP include:
- Electrical works are public assets at state agencies, public service units, people's armed forces units, Communist Party of Vietnam agencies, Vietnam Fatherland Front, socio-political organizations, socio-political-professional organizations, social organizations, socio-professional organizations, and other organizations established according to the provisions of the law on associations;
- Electricity works are public assets assigned to enterprises to manage, regardless of the state capital component in the enterprise;
- Electrical works belonging to technical infrastructure projects invested with state capital are invested by the Project Management Board, agency, organization, or unit;
- Electrical works belonging to technical infrastructure commonly used in urban area projects, residential areas, and other projects must be handed over to the State by the investor according to the provisions of the law;
- Electricity projects whose ownership is established by the entire people originate from outside the state budget (including the increased value of electrical works invested by organizations and individuals, renovating and upgrading existing electrical works of the power unit) by organizations and individuals who voluntarily transfer ownership rights to the State of Vietnam through the Vietnam Electricity in the form of non-refundable capital and the electricity unit agrees to receive it;
- Power projects with established ownership by the entire people originate from investment projects under the public-private partnership method and are transferred by agreement between the parties to the power unit according to the project contract according to the provisions of law or the competent authority decides to assign the electricity unit to perform the receiving task.
Decree 02/2024/ND-CP will take effect from March 1, 2024.
