Clarification on Social Insurance Contributions for Salaries of Non-specialized Commune-level Officials

According to the guidance of the Ministry of Labor, Invalids and Social Affairs at Official Dispatch 3479/LDTBXH-BHXH, the monthly social insurance (SI) salary for non-specialized personnel at the commune, ward, and commune-level town is the statutory pay rate.

Thus, some localities are currently paying compulsory Social Insurance for non-specialized workers at the commune, ward, and commune-level town levels based on their received allowances, which differ from the statutory pay rate (800,000 VND/month; 0.9 times or 1.2 times the statutory pay rate), and this does not comply with the provisions of the Law on Social Insurance.

Therefore, the Ministry of Labor, Invalids and Social Affairs (MOLISA) requests that Vietnam Social Security direct the Social Insurance agencies of provinces and cities to cooperate with the People's Committees of communes, wards, and commune-level towns and relevant local authorities to implement the payment and collection of Social Insurance for the mentioned individuals in conformity.

Employees who are non-specialized workers at the commune, ward, and commune-level town levels shall have their monthly salary for social insurance contributions based on the statutory pay rate. (According to Clause 1, Article 89 of the Law on Social Insurance 2014)
