On June 27, 2024, the Minister of Home Affairs (Hanoi, Vietnam) issued Circular 04/2024/TT-BNV amending and supplementing certain provisions of Circular 13/2022/TT-BNV providing guidelines for determining the structure and grades of officials in Vietnam

Amendments to the Basis for Determining the structure and grades of officials in Vietnam

Amendments to the Basis for Determining the structure and grades of officials in Vietnam are as follows:

- The determination of the structure and grades of officials within each administrative agency, organization of ministries, central authorities, and local authorities is based on:

+ The list of job positions for professional specialties and general professional specialties for officials as guided by the Ministry of Home Affairs and the management ministries and sectors in accordance with Decree No. 62/2020/ND-CP dated June 01, 2020, of the Government of Vietnam on job positions and official staffing quotas;

+ The complexity level of the work and the number of official staff positions required for each job position within the agency or organization as approved by the competent authority;

+ The professional title standards of official ranks corresponding to the job position.

- When determining the structure and grades of officials within administrative agencies and organizations, officials holding leadership and management positions are not counted.

During the period before the implementation of salary adjustment according to positions and titles as per Resolution 27-NQ/TW dated May 21, 2018, of the 7th Central Conference (12th session), on the reform of wage policy for officials and public employees, armed forces, and laborers in enterprises, officials holding leadership and management positions are eligible to take exams to ascend to ranks corresponding to the complexity of their leadership and management positions but are not counted in the official rank structure of the agency or organization. Additionally, the following regulations are also supplemented:

- The percentage of official ranks within agencies, organizations, and units under and affiliated with ministries, and equivalent agencies.

- The percentage of official ranks within specialized agencies and administrative organizations under the provincial People's Committee.

- The percentage of official ranks within specialized agencies and administrative organizations under the district People's Committee.

- The percentage of official ranks within other agencies and organizations.
