Procedures for Issuing licenses to use radio frequencies and radio devices for internal radio communication network in Vietnam

According to Part II of the Appendix issued together with Decision 1307/QD-BTTTT in 2024, the procedures for issuing licenses to use radio frequencies and radio devices for internal radio communication network in Vietnam are as follows:

(1) Procedure Steps

- Organizations or individuals complete the application for the frequency and radio equipment usage permit for internal radio communication network as specified in clauses 1 and 2 of Article 6 of Decree 63/2023/ND-CP and submit the application to the Regional Radio Frequency Center.

- The Regional Radio Frequency Center receives and checks the validity of the application.

+ In case the application is incomplete or unsatisfactory, within 05 working days from the date of receipt, the Regional Radio Frequency Center must notify and guide the organization or individual to supplement and complete the application.

+ In case the application is complete and conformable, the Regional Radio Frequency Center issues the frequency and radio equipment usage permit for the internal radio information network or refuses to issue the permit and states the reasons within 28 days from the date of receipt of the complete and conformable application.

+ In cases where the number of radio frequencies required exceeds 100 frequencies in one application or exceeds 100 frequencies in applications submitted within 28 days by one organization or individual, the Regional Radio Frequency Center issues the usage permit or refuses to issue the permit and states the reasons within 03 months.

(2) Method of Implementation

Implemented through one of the following methods:

- Direct submission at the Regional Radio Frequency Center (Address can be found on the website of the Radio Frequency Department at www.rfd.gov.vn);

- Submission via postal services;

(Address of the Regional Radio Frequency Center: available on the website of the Radio Frequency Department at www.rfd.gov.vn);

- Online submission through the online public service system: National Public Service Portal (https://dichvucong.gov.vn) or the Public Service Portal of the Ministry of Information and Communications (http://dichvucong.mic.gov.vn) or the Public Service Portal of the Radio Frequency Department (http://cappheptanso.dichvucong.mic.gov.vn).

(3) Composition of the Dossier; Number of Dossiers:

* Composition of the Dossier:

- General Information Form and Technical and Operational Parameters Declaration for internal radio communication network according to Form 1g2 specified in Appendix II of Decree 63/2023/ND-CP;

- Legal copies or lawful electronic copies of Citizen Identity Card or People's Identity Card or valid Passport (applicable to individuals); Legal copies or lawful electronic copies of Business Registration Certificate (applicable to business households).

(Organizations or individuals who have been granted electronic identification accounts by competent authorities when submitting applications through the online public service system do not need to submit lawful electronic copies of Citizen Identity Card or valid Passport or Business Registration Certificate.

For applications submitted directly or via postal services: organizations and individuals do not need to submit documents specified in clause 2, point b of clause 3 of Article 6 of Decree 63/2023/ND-CP regarding Citizen Identity Card or People's Identity Card or Business Registration Certificate or Enterprise Registration Certificate when the licensing authority can retrieve this information from the National Database on Population and the National Database on Business Registration. The specific application time of this regulation is publicly announced on the website of the frequency and radio equipment usage permit issuing authority).

- Documents related to the application (In case the licensing authority needs to verify the information in the application form to allocate radio frequencies and issue a permit) as specified in clause 4 of Article 4 Decree 63/2023/ND-CP.

* Number of Dossiers: 01 set.

(4) Processing Time:

- 28 days from the date of receipt of the complete and conformable application.

- 03 months in cases where the number of radio frequencies required exceeds 100 frequencies in one application or exceeds 100 frequencies in applications submitted within 28 days by one organization or individual.

More details can be found in Decision 1307/QD-BTTTT which comes into force in Vietnam from July 01, 2024, to December 31, 2024.
