Enhancement of the effectiveness of forensic assessment in the field of information and communication in Vietnam

On August 15, 2024, the Ministry of Information and Communications of Vietnam issued Directive 03/CT-BTTTT on the responsibility for implementation and coordination to improve the effectiveness of judicial expertise activities in the field of information and communications in Vietnam.

Enhancement of the effectiveness of forensic assessment in the field of information and communication in Vietnam

In the process of implementing judicial expertise in the field of information and communication, several limitations have been encountered, such as: the appraising agencies being confused and unable to clearly and accurately determine the content within the professional scope of information and communication, and the time for receiving and conducting the appraisal being sometimes too short and insufficient for complicated cases.

To better meet the requirements of judicial expertise in the field of information and communication in the new situation, the Minister of Information and Communications directs the entire Information and Communications sector to fulfill the following requirements and tasks:

- Reorganize the judicial expertise work across the Sector according to functions, state management scopes of the sector and territory; delineate judicial expertise by adjudication level to avoid overload and in compliance with the central inter-sectoral spirit agreed upon by the Ministry of Public Security, Supreme People's Court, Supreme People's Procuracy, Ministry of Justice, and related ministries.

- Agencies and units under the Ministry of Information and Communications, Departments of Information and Communications should promote their roles, enhance their responsibilities in reviewing, accepting, and conducting judicial expertise to ensure timely progress and compliance with legal regulations, resolutely prevent avoidance and responsibility shifting among individuals and collectives during the expertise process.

- Based on practical needs, organizations and units under the Ministry, Departments of Information and Communications should proactively monitor, review officials and public employees within their organizations, cooperate with the Ministry of Information and Communications (Legal Department), and the Department of Justice to compile lists of individuals meeting the competence and professional experience requirements for proposing the appointment of judicial experts, recognizing ad-hoc judicial experts to meet the operational requirements of judicial expertise; review and dismiss judicial experts who no longer meet the stipulated conditions.

- Research, review, and propose amendments and supplements to the regulations on functions and tasks of the Legal Department and the units to ensure responsibilities in organizing and implementing specialized judicial expertise.

- Organize training courses on judicial expertise; research and develop procedures for conducting expertise in the field of information and communication; summarize and evaluate to develop a Circular regulating judicial expertise in the field of information and communication to replace Circular 24/2013/TT-BTTTT and Circular 25/2013/TT-BTTTT.
