Vietnam: Dossiers for settlement of monthly survivorship benefits for servicemen

This is a notable content of the Circular No. 136/2020/TT-BQP providing guidance on dossiers, processes and responsibilities for handling social insurance benefits within the Ministry of National Defense of Vietnam.

According to Article 31 of the Circular No. 136/2020/TT-BQP of the Ministry of National Defense of Vietnam, dossiers for settlement of monthly survivorship benefits for servicemen; persons who do cipher work receiving salary as servicemen; national defense officials, workers and national defense employees; workers under contracts in agencies, units and enterprises attached to the Ministry of National Defense (hereinafter referred to as employee) are specified as follows:

1. Social insurance book.

2. A copy of the death certificate or death notice (for servicemen, national defense officials, workers and national defense employees) or the death certificate or death extract (workers under contracts), or a copy of the court's legally effective decision on the death declaration.

3. The dead person’s relatives’ declaration (Form No. 09A-HBQP).

4. The process of paying social insurance (Form No. 04A-HBQP).

5. Decision on funeral allowance (Form No. 08A-HBQP).

6. Decision on monthly survivorship allowance (Form No. 08B-HBQP).

7. Notice of transfer of social insurance benefits (Form No. 10A-HBQP).

8. In addition to the above-mentioned documents, for the following cases, supplementing:

- In case of death due to occupational accident or occupational disease: Minutes of investigation of occupational accidents (in case a traffic accident is determined as an occupational accident, one of the following documents must be present: Minute of the scene examination and the diagram of the scene of the traffic accident or traffic accident record of the police agency or criminal investigation agency of the Ministry of National Defense) or a copy of the patient's medical record;

- In case a relative receives a monthly survivorship allowance due to a decrease in working capacity: The original copy of the report on assessment of working capacity decrease of the Medical Assessment Council certifying the working capacity decrease from 81% or more or the certificate of extremely severe disability (equivalent to a decrease in working capacity of 81% or more) according to Circular No. 01/2019/TT-BLĐTBXH dated January 02, 2019 of the Ministry of Labor, War Invalids and Social Affairs of Vietnam on disability determinations made by the Disability Determination Council;

- In case the employee still lacks the period of payment of social insurance contributions of no more than 06 months and his/her relatives wish to continue paying social insurance premiums for the missing number of months:

- Application for one-time payment of social insurance premiums for the missing months to enjoy the monthly survivorship allowance (Form No. 14-HBQP), certified by the head of the agency or unit and the receipt of payment of one-time social insurance premiums. 

- In case a relative is a spouse, biological child, lawfully adopted child, biological parents, parents-in-law or a legal nurturer whom the deceased while still alive is responsible for nurturing, and is eligible for monthly survivorship allowance but do not reside in the same locality as the person declaring the form No. 09A-HBQP, the confirmation from a relative is additionally required (Form No. 09B-HBQP).

9. In case the employees before January 2007 work in the areas entitled to the regional allowance: Personal declaration of time and area of military service with regional allowance (Form No. 04C-HBQP).

10. In case of payment of medical assessment fee, the dossier shall be as prescribed in Clause 10 Article 9 of this Circular.
