From July 1, 2025, social insurance beneficiaries in Vietnam will have the rights as outlined in the following article.

Social insurance benefits in Vietnam from July 1, 2025

According to Article 4 of the Law on Social Insurance 2024, the social insurance benefits from July 1, 2025, include:

- Social pension allowance with the following policies:

+ Monthly social pension allowance;

+ Funeral expense assistance;

+ Enjoyment of health insurance funded by the state budget.

- Compulsory social insurance with the following policies:

+ Sickness;

+ Maternity;

+ Retirement;

+ Survivorship;

+ Accident insurance and occupational disease insurance as stipulated in the Law on Occupational Safety and Hygiene.

- Voluntary social insurance with the following policies:

+ Maternity allowance;

+ Retirement;

+ Survivorship;

+ Accident insurance as stipulated in the Law on Occupational Safety and Hygiene.

- Unemployment insurance as stipulated in the Employment Law.

- Additional retirement insurance.

08 Rights of Social insurance beneficiaries in Vietnam from July 1, 2025

Social insurance beneficiaries have the following rights:

(1) To receive social insurance benefits fully, promptly, and conveniently;

(2) To enjoy health insurance in cases of retirement; work cessation to enjoy monthly occupational accident and disease allowance; during maternity leave for 14 working days or more in a month; during leave of 14 working days or more in a month for sickness benefits or sick leave allowance for persons with diseases requiring long-term treatment as prescribed by the Minister of Health; enjoying policies as stipulated in Article 23 of the Law on Social Insurance 2024;

(3) To be reimbursed for medical examination fees in cases where the employer does not introduce the worker for a medical assessment of decreased work capacity, but the medical assessment results qualify for social insurance benefits as stipulated in the Law on Social Insurance 2024;

(4) To authorize in writing another person to implement social insurance. If the authorization involves receiving a pension, social insurance allowance, and other policies as per the Law on Social Insurance 2024, the authorization document is valid for a maximum of 12 months from the establishment date. The authorization document must be notarized as required by the law on notarization;

(5) For individuals aged 80 or older, if requested, the social insurance agency or a service organization authorized by the social insurance agency to implement pension, social insurance allowance payments at their residence within the territory of Vietnam;

(6) To periodically receive monthly information from the social insurance agency regarding social insurance benefits via electronic means; to have the social insurance agency confirm information concerning social insurance benefits upon request;

(7) To make complaints, accusations, and initiate lawsuits regarding social insurance as prescribed by law;

(8) To decline receiving social insurance benefits.

Responsibilities of Social insurance beneficiaries in Vietnam from July 1, 2025

Specifically: Clause 2, Article 11 of the Law on Social Insurance 2024 stipulates the responsibilities of Social insurance beneficiaries as follows:

- To comply with regulations concerning the procedures, and other requirements related to social insurance benefits as stipulated in the Law on Social Insurance 2024 and other relevant legal provisions;

- To repay social insurance benefits when an authorized agency determines that the benefits were improperly received;

- Annually, Social insurance beneficiaries with personal bank accounts are responsible for cooperating with the social insurance agency or a service organization authorized by the social insurance agency to verify information on eligibility for social insurance benefits.
