Vietnam: The Ministry of Defense and social security agency must keep records of social insurance benefits for military personnel

On October 29, 2020, the Ministry of Defense of Vietnam issued Circular No. 136/2020/TT-BQP providing guidance on dossiers, procedures, and responsibilities related to the settlement of social insurance benefits within the Ministry of Defense.

According to Article 35 of Circular No. 136/2020/TT-BQPregulations on the management and storage of records for the following social insurance regimes: sickness, maternity, convalescence and rehabilitation, occupational accidents, occupational diseases, retirement, and survivorship for military personnel; those engaged in cipher work enjoying salaries like military personnel; national defense officials, workers and public employees; contracted laborers in agencies, units, and enterprises under the Ministry of Defense (hereinafter referred to as laborers) are as follows:

1.  Documents for receiving sickness, maternity, and convalescence benefits shall be prepared in 1 set and stored at the unit that directly pays the benefit to the laborer.

2. Documents for receiving occupational accident and occupational disease benefits

-  Documents for receiving monthly occupational accident and occupational disease benefit

Documents for receiving monthly occupational accident and occupational disease benefits shall be prepared in 5 sets as follows:

  • 1 set stored at Vietnam Social Insurance;
  • 1 set stored at Social Insurance of the Ministry of Defense;
  • 1 set stored at the human resource department of units under the Ministry;
  • 1 set stored at the human resource department at the regiment level and equivalent where the laborer is directly managed (for forwarding to the locality when the laborer leaves the military or moves within units under the Ministry of Defense);
  • 1 set for the laborer.

Reimbursement voucher for monthly occupational accident and occupational disease benefits (Form 03N-HBQP) shall be prepared in 01 copy and kept at the Finance Department of the battalion level or equivalent unit responsible for directly disbursing payments to the worker;

Adjustment voucher for monthly occupational accident and occupational disease benefits (Form 03P-HBQP or Form 03Q-HBQP) shall be prepared in 01 copy and sent together with the notification of pension and social insurance benefits transfer to the local authorities (Form 10A-HBQP).

Documents for receiving lump-sum occupational accident and occupational disease benefits shall be prepared in 3 sets as follows:

+1 set stored at Social Insurance of the Ministry of Defense;

 

+ 1 set stored at the human resource department of units under the Ministry;

+ 1 set for the laborer.

3. Documents for receiving retirement benefits

Documents for receiving monthly retirement benefits shall be prepared in 5 sets as follows:

+ 1 set stored at Vietnam Social Insurance;

+ 1 set stored at the Social Insurance of the province/city where the laborer receives the pension;

+ 1 set stored at Social Insurance of the Ministry of Defense;

+ 1 set stored at the human resource department of units under the Ministry;

+ 1 set for the laborer.

The notification of the transition to pension and social insurance benefits (Form 10A-HBQP) shall be prepared in 1 copy and sent to the locality.

Documents for receiving lump-sum social insurance benefit shall be prepared in 3 sets as follows:

+ 1 set stored at Social Insurance of the Ministry of Defense;

+ 1 set stored at the human resource department of units under the Ministry;

+ 1 set for the laborer.

4. Documents for receiving survivorship benefits

- Documents for receiving monthly survivorship benefits shall be prepared in 5 sets as follows:

1 set stored at Vietnam Social Insurance;

+ 1 set stored at the Social Insurance of the province/city where the laborer's relative receives the benefit;

+ 1 set stored at Social Insurance of the Ministry of Defense;

+ 1 set stored at the human resource department of units under the Ministry;

+ 1 set for the laborer's relative.

If the relatives are in many provinces/cities, an additional set for each additional province/city is required.

The notification of the transition to pension and social insurance benefits (Form 10A-HBQP, 1 copy prepared for each relative receiving benefits) is sent to the locality.

1 decision on burial expense benefits is established for payment records and stored at the Financial Department directly paying the laborer's relative.

- Documents for receiving lump-sum survivorship benefit shall be prepared in 3 sets as follows:

+ 1 set stored at Social Insurance of the Ministry of Defense;

+ 1 set stored at the human resource department of units under the Ministry;

+ 1 set for the laborer'relative.

5. Laborers receiving monthly pensions (if there is a one-time allowance upon retirement or regional allowance); monthly or one-time occupational accident and occupational disease benefits; one-time social insurance benefits (discharge, resignation, and death) prepare an additional 1 copy of the decision by the Director of Social Insurance of the Ministry of Defense marked "This copy is for payment at the financial agency" to present for payment and store at the regiment-level (or equivalent) financial department directly paying the laborer or their relative.
