Vietnam: When can soldiers have their identities adjusted on social insurance books?

On October 29, 2020, the Ministry of National Defense of Vietnam issued the Circular No. 136/2020/TT-BQP providing guidance on dossiers, processes and responsibilities for handling social insurance benefits within the Ministry of National Defense.

According to the Article 37 of the Circular No. 136/2020/TT-BQP of the Ministry of National Defense of Vietnam, in case a military personnel; people doing cipher work receiving salaries like military personnel; national defense officials, workers and public employees; contract workers in agencies, units and enterprises under the Ministry of National Defense (hereinafter referred to as employees) retires from active service under a decision of a competent authority but his/her identity in the social insurance book is not consistent with his birth certificate or household registration book or citizen identification card or identity card; he/she wishes to make adjustments shall make personal adjustments on social insurance books to settle social insurance benefits. Documents to be prepared include:

- Social insurance book;

- Application form (Form 14-HBQP);

- Official Dispatch of the Head of unit under the Ministry;

- Birth certificate or household registration book or citizen identification card or identity card;

Note: The personnel agency at the regiment level and the equivalent, when preparing a dossier for settlement of social insurance benefits, is responsible for compiling this dossier and sending it together with the dossier for settlement of social insurance benefits to the superior personnel agency to the Ministry of National Defense.

Moreover, according to Article 38 of the Circular No. 136/2020/TT-BQP of the Ministry of National Defense of Vietnam, agencies, units and enterprises under the Ministry of National Defense are responsible for organizing, thoroughly grasping and implementing; directing, monitoring and inspecting the units under their management regarding the preparation of dossiers and settlement of entitlement to social insurance benefits for employees and their relatives under their management according to the guidance in this Circular and provisions of the law on social insurance.
