Recently, the Ministry of National Defense of Vietnam has issued the Circular No. 136/2020/TT-BQP providing guidance on dossiers, processes and responsibilities for handling social insurance benefits within the Ministry of National Defense.
According to the Article 34 of the Circular No. 136/2020/TT-BQP of the Ministry of National Defense of Vietnam, time limit for settling survivorship allowance for military personnel; people doing cipher work receiving salaries like military personnel; national defense officials, workers and public employees; contract workers in agencies, units and enterprises under the Ministry of National Defense (hereinafter referred to as employees) is specified as follows:
* For cases of monthly survivorship allowance
- In case the employee's relatives reside in the same province: Within 45 days from the date of death of the employee (30 days for regiment level and equivalent, 10 days for division level and equivalent, 05 days for unit level under the Ministry), the human resources agency shall complete the dossier for monthly survivorship allowance and send it to the Social Insurance Agency of the Ministry of National Defense of Vietnam (in case the employee's relatives residing in many central-affiliated provinces cities enjoy monthly survivorship allowance, the general period is not more than 90 days, of which, for regimental level and equivalent is 75 days);
- In case the father dies while the mother is pregnant, the dossier shall be made right after the mother gives birth; the time to enjoy the monthly survivorship allowance of the new-born child is counted from the month of birth.
* For cases of lump-sum survivorship allowance
- Within 45 days from the date of death of the employee (30 days for regiment level and equivalent, 10 days for division level and equivalent, 05 days for unit level under the Ministry), the personnel agency completes the dossier for lump-sum survivorship allowance and sends it to the Social Insurance Agency of the Ministry of National Defense of Vietnam;
- Within 15 days from the date of receipt of valid dossiers, the Social Insurance Agency of the Ministry of National Defense of Vietnam shall complete the decision to enjoy the survivorship allowance for the employees' relatives.
* In case the dossier is not resolved, the dossier-receiving agency must notify the employee's relatives in writing and clearly state the reason.
