1. Reduced 37 fees and charges from January 1, 2022 - June 30, 2022

The Ministry of Finance has issued  Circular 120/2021/TT-BTC  stipulating the collection of a number of fees and charges in order to support and remove difficulties for those affected by the COVID-19 epidemic.

Accordingly, 37 fees and charges will be reduced from January 1, 2022 to the end of June 30, 2022, of which, 03 additional fees and charges will be added to the list of reduced fees and charges. As follows:

- 50% reduction for the fee for the issuance of the Certificate of technical safety and environmental protection for motor vehicles and special-use motorcycles:  the new fee will be 25,000 VND/paper, only the Certificate is issued to Cars with less than 10 seats (excluding ambulances) are 50,000 VND/paper.

 - 50% reduction of the inland waterway reporting fee:  the new fee will be 50,000 VND/time (for seagoing ships and seaplanes) and 25,000 VND/time (for inland waterway vessels and foreign watercraft). ).

 - Reduce 20% of the fee for using radio frequencies for the terrestrial mobile service (the land mobile telecommunications network for private messaging and the private telecommunications network using frequencies in the mobile and telecommunications services). trunk terrestrial mobile communication).

In addition, many fees and charges are also reduced by up to 50% compared to the previously regulated fee, such as:

- 50% reduction in the fee for licensing the bank's establishment and operation;

- 50% discount on appraisal and issuance of international travel service business license, domestic travel service business license;

- 50% reduction in the fee for issuance of a citizen's identity card;...

From July 1, 2022 onward, fees and charges in Circular 120/2021 shall comply with current regulations.

2. Increase fines for many traffic violations from 2022

Decree 123/2021/ND-CP  amending and supplementing a number of articles of the Decrees providing for penalties for administrative violations in the maritime domain; road and railway traffic; domestic airline.

Accordingly, the fines will be increased for many traffic violations from January 1, 2022, for example:

- Double the fine for motorcyclists without helmets, specifically:

A fine of between VND 400,000 and VND 600,000 for vehicle operators:

+ Failure to wear “helmets for motorcyclists” or “helmets for motorcyclists” that do not properly fasten the straps when operating the vehicle in traffic on the road.

+ Carrying people in vehicles without wearing “helmets for motorcyclists and motorbike riders” or wearing “helmets for motorcyclists and motorbikes” without proper straps, except for the case of transporting sick patients. giving first aid, children under 06 years old, escorting people who commit illegal acts;

(Currently, the fine for these violations is a fine from 200,000 VND to 300,000 VND).

- Increase the fine for people from full 16 years old to under 18 years old driving cars, tractors, vehicles similar to cars, this act will be fined from 2,000,000 VND to 4,000,000 VND . formerly from 1,200,000 VND to 3,000,000 VND).

- Increased fines for drivers of two-wheeled motorcycles with a cylinder capacity of 175 cm3 or more without a driver's license, or using an erased or invalid driver's license: a fine of from VND 4,000,000 up to 5,000,000 VND (previously 3,000,000 VND to 4,000,000 VND)...

3. Heavy fines for the act of enrolling in the wrong university

This is a notable content in Decree 127/2021/ND-CP amending Decree 04/2021/ND-CP on sanctioning administrative violations in the field of education.

Accordingly, from January 1, 2022, university admissions to the wrong subjects specified in the enrollment regulation of 30 or more learners will be subject to a fine of between VND 110 and 150 million.

(Previously, according to the old regulations, a fine of 70-100 million dong).

For the case of enrollment for master's and doctoral training in the wrong subjects with 10 or more learners, a fine of from 110 to 150 million dong (according to the old regulations, a fine of 70-100 million dong). .

4. Failure to notify the maximum foreign ownership rate will be fined up to 70 million VND

This is a notable content in Decree 128/2021/ND-CP amending and supplementing Decree 156/2020/ND-CP stipulating penalties for administrative violations in the securities sector and securities market.

Accordingly, additional regulations on penalties for violations of regulations on notification of maximum foreign ownership ratio in public companies are as follows:

- A fine of between VND 30 and 50 million shall be imposed on a public company that fails to notify the change of the maximum foreign ownership ratio within the time limit specified in Article 141 of Decree 155/2020/ND-CP .

- A fine ranging from VND 50,000,000 to VND 70,000,000 shall be imposed on a public company that fails to notify the maximum foreign ownership ratio or change the maximum foreign ownership ratio.

At the same time, it is required to submit a dossier of notification of the maximum foreign ownership ratio in a public company or of a change in the maximum foreign ownership ratio in a public company within 07 days from the date of decision to apply. take this measure into force.

Decree 128/2021/ND-CP takes effect from January 1, 2022.
