Promulgation of the Code of Conduct of State Auditors; pilot assignment of the state management of 8 fields to Ho Chi Minh City Authorities; etc., are notable documents that will be covered in this bulletin.

1. Vietnam's Code of Conduct of State Auditors 

On July 8, 2024, the Auditor General of the State Audit Office of Vietnam promulgated Decision No. 1337/QD-KTNN on the Code of Conduct of State Auditors. 

Purposes of the Code of Conduct of State Auditors:

- To strictly comply with regulations of the CPV and the State on the control of powers and prevention and combat against corruption and negativity in the examination, supervision, and implementation of the discipline of the CPV and inspection and audit. 

- To concretize and publicly implement the code of conduct of state auditors during participation in audit activities and social relations. 

- To improve the sense of responsibility, occupational ethics, and professionalism of state auditors; to enhance the prestige of state auditors; and to intensify the operational efficiency and audit quality of state auditors. 

- To be used as the basis for relevant organizations and individuals to supervise the behaviors of state auditors while participating in audit activities and social relations, contributing to the effective implementation of Democratic Regulations in affiliates of the State Audit Office of Vietnam. 

- To be used as the basis for affiliates of the State Audit Office of Vietnam (within their assigned jurisdiction) to implement their responsibilities when state auditors violate conduct regulations or standards during participation in audit activities and social relations.

2. Advisory service scope of credit institutions in Vietnam 

On July 1, 2024, the Governor of the State Bank of Vietnam promulgated Circular No. 38/2024/TT-NHNN on advisory service provision by credit institutions and foreign bank branches. 

Advisory service scope of credit institutions is as follows: 

- Credit institutions providing advisory services may only provide advisory services concerning banking operations and other business operations prescribed in licenses granted by the State Bank of Vietnam. 

- Solutions and schemes prescribed in Clause 1 Article 3 of Circular No. 38/2024/TT-NHNN shall be implemented by credit institutions providing advisory services or other credit institutions in conformity with the scope of banking operations and other business operations in conformity with the licenses granted by the State Bank of Vietnam to credit institutions.

3. Amendments to regulations on time limit for organization of firefighting plan drills 

On July 10, 2024, the Minister of Public Security of Vietnam promulgated Circular No. 32/2024/TT-BCA on amendments to Circular No. 149/2020/TT-BCA guiding the Law on Fire Prevention and Fighting, which contains contents concerning documents supporting management and monitoring of fire prevention and fighting. 

According to the Circular, regulations on the time limit for organization of firefighting plan drills are as follows: 

- Drills of grassroots-level firefighting plans subject to the management of fire prevention and fighting, residential areas, and motor vehicles subject to special fire safety requirements shall be organized at least once a year or irregularly upon requests for assurance of fire safety for local special events concerning political, economic, cultural, and social matters.  Every drill shall contain one or many different situations. All of the situations in the plans shall be organized for practice. 

- Drills of firefighting plans of Public Security Authorities shall be organized upon requests from competent persons who approve such plans.  Before organizing the drills, Public Security Authorities shall issue written notices to Presidents of People’s Committees of communes and heads of the facilities where the drills take place at least 5 working days in advance while requesting the mobilization of forces and vehicles from agencies, organizations, households, and individuals mobilized to participate in the drills at least 5 working days in advance.

4. Pilot assignment of state management of 8 fields to Ho Chi Minh City Authorities in Vietnam 

On July 10, 2024, the Government of Vietnam promulgated Decree No. 84/2024/ND-CP on the pilot assignment of the state management of 8 fields to Ho Chi Minh City Authorities. 

Decree No. 84/2024/ND-CP stipulates the pilot assignment of the state management between the Government of Vietnam and Ho Chi Minh City Authorities (People's Council and People's Committee of Ho Chi Minh City) regarding the following fields: 

- State management of investment. 

- State management of economy, finance, and state budget. 

- State management of planning, construction, and natural resources and environment. 

- State management of transport. 

- State management of health. 

- State management of education and training. 

- State management of labor and vocational education. 

- State management of home affairs.
