Decree 30: From March 05, 2020, documents are required to have a legal basis

Recently, the Government of Vietnam issued Decree 30/2020/ND-CP on clerical work, replacing Decree 110/2004/ND-CP and Decree 09/2010/ND-CP. This decree officially takes effect from March 5, 2020.

Decree 30/2020/ND-CP stipulates that one of the contents of administrative documents is the basis for issuing the document.

The basis for issuing a document includes the documents stipulating the authority, functions, tasks of the issuing agency, organization, and the documents defining the content and basis for issuing the document.

The basis for issuing a document is recorded with the full name of the document type, number, symbol, issuing agency, date of issue, and summary of the document content (except for Laws and Ordinances which do not record the number, symbol, or issuing agency).

Decree 30/2020/ND-CP also clearly stipulates that the basis for issuing documents is presented in lowercase letters, italic font style, size from 13 to 14, presented below the document type name and the summary of the document content; each basis must be on a new line, ending the line with a semicolon (;), and the last line ending with a period (.).

Previously, according to Circular 01, depending on the type and content, the document could have a legal basis for issuance but it was not mandatory to have a basis for issuing the document as stipulated in Decree 30/2020/ND-CP.

Thus, from March 05, 2020, the issued document must have a part that indicates the basis for issuing the document, and this basis is presented below the document type name and summary of the document content in lowercase letters, italic font style, size from 13 to 14.

Additionally, Decree 30/2020/ND-CP also includes some changes in the regulations on document page numbers, specifically, the document page numbers are counted from 1, using Arabic numerals, size from 13 to 14, in an upright font style, centered horizontally in the upper margin, and the first page number is not displayed.

Previously, Circular 01/2011/TT-BNV stipulated that the page number was presented at the right corner at the bottom of the page (footer section) using Arabic numerals, size from 13 to 14, in an upright font style, and the first page number was not displayed. The appendix page numbers were separately numbered for each appendix.
