What are the duties and powers of the Mobile Police?

The Mobile Police Ordinance 2013 was promulgated on December 23, 2013. This Ordinance stipulates various issues related to the mobile police force such as organization, operation, functions, duties, etc. of the mobile police. So, specifically, what are the duties and powers of the mobile police as stipulated in this Ordinance?

According to the provisions of Article 7 of the 2013 Ordinance on Mobile Police, the Mobile Police has the following duties and powers:

  1. Advising the Central Public Security Party Committee and the Ministry of Public Security on armed security protection, maintenance of order and social safety, and building the Mobile Police force.

  2. Implementing plans to combat activities that sabotage security, armed rebellions, terrorism, hostage situations; suppressing crimes involving the use of weapons; dispersing unlawful disturbances and demonstrations.

  3. Organizing patrols, controlling and handling violations of laws related to security, order, and social safety; conducting certain investigative activities as prescribed by law.

  4. Organizing protection of important political, economic, diplomatic, scientific-technical, cultural targets, special shipments, conferences, and significant events as stipulated by the Government of Vietnam.

  5. Participating in court protection, escorting defendants and suspects, and assisting in the protection of prisons, detention centers, and the execution of criminal sentences as per the regulations of the Minister of Public Security.

  6. Organizing training and political, legal, professional education; developing and rehearsing operational tactics, patrol plans, and target protection plans following the functions and duties of the Mobile Police.

  1. Managing, training, and utilizing service animals.

  2. Performing ceremonial duties in the People's Public Security.

  3. Participating in search, rescue, and disaster relief efforts.

  4. Cooperating with local forces, units, and localities where stationed in building the movement for all people to protect national security.

  5. Having the right to mobilize individuals and organizations' people and means in urgent situations to handle the situations specified in Clause 2 of this Article or to pursue violators and rescue people in distress.

  6. Requisitioning assets to serve the activities of the Mobile Police as per the laws on asset requisition and commandeering.

  7. Having the right to request agencies, organizations, and individuals to provide diagrams, designs, and project drawings and to enter individuals' residences, agency headquarters, and organizational premises to rescue hostages, suppress terrorist acts, and crimes involving the use of weapons. Entry into the premises of foreign diplomatic missions, consular missions, international organization representatives, and residences of members of these agencies in Vietnam must comply with Vietnamese laws and international treaties to which Vietnam is a signatory.

  8. Managing weapons, explosives, supporting tools, and technical means serving the Mobile Police's operations as per regulations by the Minister of Public Security.

  9. Engaging in international cooperation as prescribed by law.

  10. Performing other tasks and exercising other powers as prescribed by law.
