Vietnam: Power to impose penalties of inspectors in civil aviation sector

The Government of Vietnam issued Decree No. 162/2018/NĐ-CP on November 30, 2018, which specifies the power to impose penalties of inspectors in civil aviation sector.

According to Decree No. 162/2018/NĐ-CP of Vietnam’s Government, inspectors and the persons assigned to carry out specialized inspections in civil aviation sector shall have the power to:

- Issue warning;

- Impose a fine up to VND 500,000;

- Confiscate the exhibits and instrumentalities used for committing administrative violations, the value of which does not exceed the fine rate specified in Point b of this Clause;

- Impose the remedial measures as prescribed.

The Chief Inspector of the Civil Aviation Authority of Vietnam and heads of inspectorates established by the Civil Aviation Authority of Vietnam shall have the power to:

- Issue warning;

- Impose a fine up to VND 50,000,000;

- Suspend licenses or practicing certificates, or suspend operations for fixed periods;

- Confiscate the exhibits and instrumentalities used for committing administrative violations, the value of which does not exceed the fine rate specified in Point b of this Clause;

- Impose the remedial measures as prescribed.

Concurrently, Decree No. 162/2018/NĐ-CP also stipulates that heads of inspectorates established by the Ministry of Transport shall have the power to:

- Issue warning;

- Impose a fine up to VND 70,000,000;

- Suspend licenses or practicing certificates, or suspend operations for fixed periods;

- Confiscate the exhibits and instrumentalities used for committing administrative violations, the value of which does not exceed the fine rate specified in Point b of this Clause;

- Impose the remedial measures as prescribed.

The Chief Inspector of the Ministry of Transport and the Director General of the Civil Aviation Authority of Vietnam shall have the power to:

- Issue warning;

- Impose a fine up to VND 100,000,000;

- Suspend licenses or practicing certificates, or suspend operations for fixed periods;

- Confiscate the exhibits and instrumentalities used for committing administrative violations;

- Impose the remedial measures as prescribed.
