Vietnam: How are violations against regulations on aircraft nationality sanctioned?

This is a notable content specified in Decree No. 162/2018/NĐ-CP of Vietnam’s Government prescribing administrative penalties for civil aviation offenses.

According to Decree No. 162/2018/NĐ-CP of Vietnam’s Government, a fine ranging from VND 20,000,000 (twenty million) to VND 30,000,000 (thirty million) shall be imposed for committing one of the following violations:

- Operating an aircraft on which the nationality mark or registration mark is painted or affixed improperly;

- Operating a Vietnamese-nationality aircraft the mark painted or affixed on which has a form or contents similar to or causing the confusion with the nationality mark or registration mark of an aircraft bearing another nationality.

A fine ranging from VND 30,000,000 (thirty million) to VND 50,000,000 (fifty million) shall be imposed for operating an aircraft which has no nationality or registration mark painted or affixed on which.

A fine ranging from VND 50,000,000 (fifty million) to VND 60,000,000 (sixty million) shall be imposed for operating an aircraft without a certificate of nationality registration, except the flight test performed to check the aircraft’s functions as regulated by the Ministry of National Defence.

Moreover, Decree No. 162/2018/NĐ-CP also stipulates remedial measures, which is enforced removal of elements of violation from the aircraft if any of the violations prescribed above is committed.
