Traffic Police must investigate, verify, and handle waterway traffic accidents within 07 days in Vietnam

Recently, the Ministry of Public Security has promulgated Circular 64/2020/TT-BCA stipulating the procedures for investigating and resolving inland waterway traffic accidents by the Traffic Police Force in Vietnam.

Traffic Police must investigate, verify, and handle waterway traffic accidents within 07 days in Vietnam (Internet image)

Pursuant to Article 18 of Circular 64/2020/TT-BCA regulating the time limit for investigating and verifying traffic accidents. If the traffic accident does not show signs of a crime, the time frame for investigation and verification in Vietnam is as follows:

1. Upon receiving a report of a traffic accident, the Traffic Police must conduct an investigation, verify, and resolve within 07 days; if the traffic accident has many complicated details requiring further verification, the time limit may be extended but not beyond 30 days from the date of receiving the traffic accident report. In cases requiring professional assessment or additional time for verification and collection of documents, evidence, the authorized person must report in writing to their direct supervisor to request an extension; the extension must be in writing, and the extended time limit cannot exceed 30 days.

2. At the end of the investigation, verification, and resolution period, the Traffic Police must issue a Notification of Investigation, Verification, and Resolution Results of the Traffic Accident according to Form 13/TND-T issued as per this Circular and handle following administrative law regulation in Vietnams.

Simultaneously, based on the investigation and verification activity file, documents, Traffic Police officers shall report the results and propose the resolution of the traffic accident according to Form 14A/TND-T issued under this Circular, and submit to authorized leaders for resolving the inland waterway traffic accident.
