To allow the Department of Quality, Processing, and Market Development to continue applying a special income mechanism in Vietnam (Internet image) 

Regarding this issue, LawNet would like to answer as follows:

On December 15, 2023, the Government Office issued Notice 523/TB-VPCP concluding the conclusion of Deputy Prime Minister Le Minh Khai at the meeting on the proposal to apply a financial and income management mechanism associated with specific characteristics. according to Decisions 17/2020/QD-TTg for the Department of Quality, Processing, and Market Development for the 2023 budget year.

To allow the Department of Quality, Processing, and Market Development to continue applying a special income mechanism in Vietnam

After listening to the reports and statements of the delegates attending the meeting, Deputy Prime Minister Le Minh Khai concluded as follows:

- The agencies attending the meeting agreed:

(i) The Department of Quality, Processing and Market Development, Ministry of Agriculture and Rural Development was formed by merging the Department of Agro-Forestry-Fishery and Fishery Quality Management and the Department of Agricultural Product Processing and Market Development; At the same time, Decisions 17/2020/QD-TTg and 11/2021/QĐ-TTg of the Prime Minister stipulated financial mechanisms and specific income for the Department of Agricultural, Forestry and Fisheries Quality Management; reviewing and allowing the Department of Quality, Processing and Market Development to continue applying special financial and income mechanisms specified in Decisions 17/2020/QD-TTg and 11/2021/QĐ-TTg mentioned above are necessary and consistent with practical requirements.

(ii) To ensure legal rigor, the Ministry of Agriculture and Rural Development needs to report and propose to the Government that it consider amending and supplementing Decree 105/2022/ND-CP on the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development to specify regulations to implement the content stated in (ii).

- The Ministry of Agriculture and Rural Development received comments at the meeting and promptly chaired and coordinated with the Ministries of Home Affairs, Finance, and related agencies to complete documents to submit to the Government on amending and supplementing Decree 105/2022/ND-CP in accordance with the prescribed order and procedures, reporting to the Government before December 25, 2023.

Position and functions of the Department of Quality, Processing, and Market Development in Vietnam

- The Department of Quality, Processing, and Market Development is an organization under the Ministry of Agriculture and Rural Development, based on the arrangement and consolidation of the Department of Quality Management of Agricultural, Forestry, and Fisheries and the Department of Agricultural Product Processing and Market Development.

- The Department of Quality, Processing, and Market Development (hereinafter abbreviated as the Department) performs the function of advising and assisting the Minister in state management and organizing law enforcement in the fields of quality, food safety, preservation, processing, and market development of agricultural, forestry, and fishery products within the scope of state management of the Ministry according to the decentralization and authorization of the Minister.

- The Department has legal status, has its own account and seal, and has an operating budget according to the provisions of the law.

- The Department's headquarters are located in Hanoi.
