Specific Regulations on the Organization of Drafting National Standards

Recently, the Ministry of Industry and Trade issued Circular 46/2014/TT-BCT on the activities of developing and applying national standards and national technical regulations by the Ministry of Industry and Trade.

Circular 46/2014/TT-BCT specifically regulates the organization of national standards drafting of the Ministry of Industry and Trade as follows:

1. Establishment of a Drafting Team

Units assigned to lead the drafting of national standards (Drafting Organization) must meet the requirements stipulated in the commitments to fully implement the principles of developing TCVN in accordance with the Law on Standards and Technical Regulations and the requirements for good practice in standard construction specified in Appendix 3 of the WTO Agreement on Technical Barriers to Trade; strictly adhere to the procedures for developing TCVN.

2. Drafting the national standards

Preparation for drafting

- Collect, aggregate, and assess the current situation of related legal documents regarding the national standards drafting project;

- Survey and evaluate the relevant management objects and main content of the national standards drafting project (if any);

- Organize the collection of information, documents, methodologies, and research results related to the national standards drafting project;

- Approve the detailed outline for implementation;

- Other related tasks.

Implement the drafting of national standards and organize the acceptance of the national standards drafting project

- Draft the standard and the explanatory note for the draft;

- Organize conferences, seminars, and solicit opinions from experts and stakeholders on the national standards draft;

- Research, absorb feedback, and revise the draft;

- Accept the results of the national standards drafting project; submit the draft standard and related documents to the Department of Science and Technology.

Additionally, this Circular also stipulates that the national standards draft must be solicited for opinions from relevant organizations and individuals, and announced on the websites of the Ministry of Industry and Trade and the Directorate for Standards, Metrology and Quality for a minimum period of 60 (sixty) days. The content of the solicitation of opinions is specified in this Circular. If necessary, the Department of Science and Technology will cooperate with the drafting unit to organize thematic conferences with the participation of relevant parties to discuss and comment on the draft; In special cases relating to health, safety, or the environment, the period for soliciting opinions on the national standards draft may be shortened by the decision of the Minister of Industry and Trade.

Based on the feedback, the unit leading the national standards drafting and the Drafting Team will absorb, finalize, and prepare the national standards draft dossier according to regulations.
