Rights, obligations, and responsibilities regarding cultural heritage in Vietnam from January 1, 2025

The following article will address the regulations on the rights, obligations, and responsibilities concerning cultural heritage in Vietnam from January 1, 2025.

Rights, obligations, and responsibilities regarding cultural heritage in Vietnam from January 1, 2025

Article 5 of the Cultural Heritage Law 2024 stipulates the rights, obligations, and responsibilities regarding cultural heritage in Vietnam as follows:

(1) Rights of agencies, organizations, units, communities, families, lineages, legal entities, and individuals towards cultural heritage include:

- Legal ownership of cultural heritage; recognition and protection of intellectual property rights;

- Visiting, researching, collecting, and documenting cultural heritage;

- Exploiting, utilizing, and promoting the values of cultural heritage;

- Receiving State rewards according to legal regulations;

- Trading, buying, selling, exchanging, gifting, bequeathing, practicing, teaching cultural heritage, and other rights as stipulated by Cultural Heritage Law 2024 and related legal regulations.

(2) Obligations and responsibilities of agencies, organizations, units, communities, families, lineages, legal entities, and individuals towards cultural heritage include:

- Complying with laws on cultural heritage;

- Respecting, protecting, and promoting the values of cultural heritage;

- Preventing or recommending State authorities to promptly prevent and handle acts prohibited under Article 9 of this Law and other law violations;

- Promptly reporting on the location where relics, antiques, national treasures, documentary heritage, historical-cultural relics, or scenic sites are discovered; handing over relics, antiques, national treasures, or documentary heritage found to the nearest competent State authority;

- Other obligations and responsibilities as specified by law.

(3) Rights of cultural heritage owners include:

- Enjoying benefits from protecting and promoting the values of cultural heritage as stipulated by law;

- Receiving support and cooperation from competent State cultural authorities in identifying, valuing, and processing procedures to include in inventory lists; being able to keep information confidential upon request;

- Receiving support and cooperation from competent State cultural authorities in professional preservation, protection, and documentation, creating conditions to protect and promote the values of cultural heritage per agreement;

- Receiving support and guidance from competent State authorities in activities protecting, promoting the values of cultural heritage;

- Depositing documentation of intangible cultural heritage, relics, antiques, national treasures, and documentary heritage at public museums or State agencies, State organizations with proper authority and function when lacking conditions and capacity to protect and promote the value;

- Other rights as stipulated by law.

(4) Responsibilities of cultural heritage owners include:

- Creating favorable conditions for visiting, accessing, and researching cultural heritage as stipulated by law;

- Implementing measures to protect and promote the values of cultural heritage; promptly notifying competent State authorities in cases where cultural heritage is at risk of value distortion, destruction, or loss;

- Other responsibilities as stipulated by law.

(5) Rights of agencies, organizations, units, communities, families, lineages, legal entities, and individuals managing cultural heritage include:

- Being considered by the State for support in funding to protect and promote the values of cultural heritage;

- Managing, exploiting, utilizing, and promoting the values of cultural heritage based on ensuring no impact on the original factors constituting the relic and the integrity of inherent values of cultural heritage;

- Other rights as specified by law.

(6) Responsibilities of agencies, organizations, units, communities, families, lineages, legal entities, and individuals managing cultural heritage include:

- Creating favorable conditions for visiting, accessing, and researching cultural heritage as stipulated by law;

- Protecting and preserving cultural heritage;

- Implementing preventive measures, promptly stopping acts violating cultural heritage;

- Promptly notifying the owner or competent State authority in the locality when cultural heritage shows signs of value distortion, risk of destruction, or loss;

- Other responsibilities as stipulated by law.
