The following article discusses the penalties for violations regarding the licensing for meteorological and hydrological forecasting and warning activities in Vietnam from February 01, 2025, as stipulated in Decree 155/2024/ND-CP.

On December 10, 2024, the Government of Vietnam issued Decree 155/2024/ND-CP stipulating the penalties for administrative violations in the field of meteorology and hydrology.
According to Article 6 of Decree 155/2024/ND-CP, the penalties for violations regarding licenses for meteorological and hydrological forecasting and warning activities in Vietnam are as follows:
- A fine ranging from 15,000,000 VND to 20,000,000 VND for any of the following violations:
+ Conducting forecasting, warning activities beyond the scope permitted by the license content;
+ Providing forecasting, warning information to entities not specified in the license content;
+ Altering or erasing to falsify license content;
+ Conducting meteorological and hydrological forecasting and warning activities with an expired license for less than 6 months;
+ Failing to comply with the procedures registered in the license application.
- A fine ranging from 20,000,000 VND to 25,000,000 VND for acts of unauthorized lending or leasing of licenses.
- A fine ranging from 25,000,000 VND to 30,000,000 VND for any of the following violations:
+ Conducting meteorological and hydrological forecasting, warning activities without a license;
+ Conducting forecasting, warning activities with a license expired for 6 months or more.
- Additional sanctions:
+ Revocation of the license for meteorological and hydrological forecasting, warning activities for from 6 months to 12 months for violations specified in point a and point b, clause 1, Article 6 of Decree 155/2024/ND-CP;
+ Confiscation of the materials and means used to commit violations specified in point c and point d, clause 1, clause 2, and point b, clause 3, Article 6 of Decree 155/2024/ND-CP.
- Remedial measures:
+ Required submission of the altered or erased licenses to the competent authority handling the administrative violation for the violation specified in point c, clause 1, Article 6 of Decree 155/2024/ND-CP;
+ Required submission of the illegal profits obtained from committing violations specified in clauses 1, 2, and 3, Article 6 of Decree 155/2024/ND-CP;
+ Required cancellation of results, products, data, bulletins, publications obtained from violations specified in clause 1 and clause 3, Article 6 of Decree 155/2024/ND-CP.
Note: The fines stipulated in Chapter II of Decree 155/2024/ND-CP apply to administrative violations by individuals. For organizations with the same violations, the fines are double those for individuals. (According to clause 1, Article 5 of Decree 155/2024/ND-CP)
Refer to Decree 155/2024/ND-CP effective from February 1, 2025.
Decree 155/2024/ND-CP annuls the contents in the following Decrees:
- Clause 2, Article 1, Chapter II, point a, clause 2, Article 21; the phrase "meteorology and hydrology" in the title of the Decree, promulgation basis, title of Chapter IV, in clause 1 and clause 4, Article 1, in Article 2, in clause 1, Article 3, point a, clause 1, Article 20 of Decree 173/2013/ND-CP by the Government of Vietnam regarding penalties for administrative violations in the field of meteorology, hydrology, surveying, and cartography;
- Decree 84/2017/ND-CP by the Government of Vietnam amending, supplementing a number of articles of Decree 173/2013/ND-CP by the Government of Vietnam regarding penalties for administrative violations in the field of meteorology, hydrology, surveying, and cartography;
- Article 3 of Decree 04/2022/ND-CP by the Government of Vietnam amending, supplementing a number of articles of the Decrees regarding penalties for administrative violations in the fields of land, water resources, and minerals, meteorology, hydrology, surveying, and cartography.
