On December 9, 2024, the Ministry of Transport of Vietnam issued Decision 1501/QD-BGTVT regarding the announcement of administrative procedures that are amended, supplemented, replaced, or abolished in the field of Roadways under the management jurisdiction of the Ministry of Transport.

Procedures for approving the design of connection intersections to national highways in operation in Vietnam

(1) Implementation Process:

* Submitting the administrative procedure application:

The project investor for constructing interchanges connecting to national highways under operation submits the application to the competent authority:

- For national highways managed by the Ministry of Transport of Vietnam:

+ The Vietnamese Road Administration approves the design of interchanges connecting to expressways, national highways planned to become expressways;

+ The Regional Road Management Office manages other national highways within their jurisdiction;

- For national highways managed by the provincial People's Committee: The provincial People's Committee organizes the approval of the design of interchanges connecting to national highways under operation.

* Processing the administrative procedure:

- For applications submitted directly, the competent authority checks the contents of the application. If complete, it receives and writes a receipt for returning results; if incomplete, it guides the investor to complete the application as per regulations;

- For applications submitted indirectly, within 02 working days from receipt, the competent authority checks the contents of the application. If complete, it receives it; if incomplete, it issues a written notice to the organization or individual for supplementation;

- Within 07 working days from receiving a complete application as per regulations, the competent authority reviews the application. If conditions are met, it issues a written approval for the design of interchanges connecting to national highways under operation. If not approved, a written refusal with reasons must be provided.

(2) Application Components:

- Application form as per regulations;

- Survey documents, construction design drawings for the interchange connecting to national highways under operation, including: design explanation, design drawings of the interchange connection and drawings for infrastructure restoration of the national highway, drawings for traffic organization at the interchange connection, topographic and geological survey records; document/decision approving the connecting point to the national highway under operation except for connecting points that do not require approval as per the Decree detailing and guiding the implementation of some articles of the Road Law, Article 77 of the Road Traffic Safety Law;

- Document authorizing the project investor for constructing the interchange connecting to national highways under operation.

(3) Authority Implementing Administrative Procedure:

* Competent authority for resolution:

- For national highways managed by the Ministry of Transport:

+ The Vietnamese Road Administration approves the design of interchanges connecting to expressways, national highways planned to become expressways;

+ The Regional Road Management Office manages other national highways within their jurisdiction;

- For national highways managed by the provincial People's Committee: The provincial People's Committee organizes the approval of the design of interchanges connecting to national highways under operation.

* Authority or person authorized or decentralized to implement: None;

* Direct administrative procedure implementing authority:

- For national highways managed by the Ministry of Transport:

+ The Vietnamese Road Administration approves the design of interchanges connecting to expressways, national highways planned to become expressways;

+ The Regional Road Management Office manages other national highways within their jurisdiction;

- For national highways managed by the provincial People's Committee: The provincial People's Committee organizes the approval of the design of interchanges connecting to national highways under operation.

* Coordinating agency: None.
