Regarding this issue, LawNet would like to answer as follows:

On October 10, 2023, the Central Executive Committee issued Regulation 125-QD/TW regulating the functions, tasks, and working relationships of party committees and grassroots cells in public service units. 

Regulations on working relationships between party committees and grassroots cells in public service units in Vietnam

Specifically, the working relationship between party committees and grassroots cells in public service units is guided by the Secretariat as follows:

(1) For provinces, city party committees, and party committees directly under the Central Government (referred to as provincial party committees); districts, towns, city party committees, and equivalents under provincial and city party committees (referred to as district party committees)

- The Provincial Party Committee and the District Party Committee provide direct leadership and direction on political orientation, important work contents, and personnel work for public service units at their level through the unit's party committee according to the working regulations of the executive committee, standing committee, standing committee of the provincial party committee, city party committee, and district party committee.

- Directive documents from the provincial or district party committees sent to the party committees of public service units are implemented as follows: for advisory and assisting agencies of Party Committees, Party Unions, Party Committees, District and Commune Party Committees. Party committee secretaries and heads of public service units are invited to attend meetings with related content convened by the Standing Committee and Standing Party Committee.

- Party committees of public service units shall implement regular and extraordinary reporting regimes with the Standing Committee and Standing Party Committees at provincial and district levels according to regulations.

(2) For party cadres of People's Committees of provinces and centrally run cities; District People's Committee and equivalent

- Party cadres, People's Committees of provinces and centrally-run cities, district-level People's Committees and equivalent leaders of party committees, and public service units directly implement the resolutions and decisions of the provincial, district, and equivalent Party Committees on political tasks, cadre work according to decentralization and related issues.

- Documents from the Party Committee, Provincial People's Committee, and District People's Committee with relevant content are sent to the Party Committee of the affiliated public service unit for implementation.

(3) For immediate superior party committees

- Party committees and grassroots cells in public service units are subject to the regular and comprehensive leadership of the immediate superior party committee on party building and the implementation of assigned political tasks.

- Periodically (6 months, 1 year) or irregularly when required, the party committee reports and asks for opinions from the immediate superior party committee on the leadership, direction, and organization of political tasks of the party committee and cell.

(4) For heads of units and the chairman of the management board (school council)

- Party committees, party cells, and party committees coordinate closely with unit heads and the chairman of the management board (school council) in carrying out assigned responsibilities and powers. The Party Committee regularly informs the unit heads and the chairman of the management board (school council) about the opinions of party members, officials, and workers in implementing tasks, policies, and regimes in agencies and units.

The head of the unit and the chairman of the management board (school council) are responsible for ensuring and creating conditions for party cells to implement this Regulation.

- Periodically (6 months, 1 year, party congress) or irregularly when required, the head of the unit, the chairman of the management board (school council), reports to the party committee or congress about the unit's operational results, policies, and tasks; Party committees or party committees and cells discuss and issue resolutions on major and important issues for the leaders of party members and the masses in the unit to implement.

- The secretary, unit head, and chairman of the management board (school council) are responsible before the party organization and the law when violations of party discipline, corruption, and negativity occur in the unit. When the party committee, branch committee, head of the unit, and chairman of the management board (school board) have different opinions, the head of the unit and chairman of the management board (school board) shall decide according to their authority and take responsibility for that decision; at the same time, party committees, unit heads, and the chairman of the management board (school council) report to the competent superiors.

(5) For party committees and local authorities

Party committees of public service units maintain close relationships with party committees and local authorities where party organizations and units are located in the area and where working party members of the unit reside.

More details can be found in Regulation 125-QD/TW, taking effect on October 10, 2023 and replacing Regulation 97-QD/TW dated March 22, 2004.
