Regulations on the Dossier of Drafting National Technical Standards of the Ministry of Industry and Trade

Regulation on the dossier of the draft national technical regulation by the Ministry of Industry and Trade (Illustrative image)

Circular 46/2014/TT-BCT regulates the appraisal dossier, the verification dossier at the Ministry of Science and Technology, and the appraisal dossier at the Legal Department of the draft national technical regulation. Specifically as follows:

1. Appraisal Dossier

- Decision assigning the task of implementing the national technical regulation project to the drafting agency or organization, accompanied by an approved explanation and outline;- Report on the process of developing the draft national technical regulation;- Draft national technical regulation (including both the draft text and electronic file) accompanied by copies of original documents used as a basis for drafting the national technical regulation and other reference documents;- List of organizations and individuals consulted for opinions; summary and response to feedback along with the feedback documents;- Other documents and materials;- Official Dispatch requesting appraisal.

2. Appraisal Dossier at the Ministry of Science and Technology

- Decision assigning the task of implementing the national technical regulation project to the drafting agency or organization, accompanied by an approved explanation and outline;- Report on the process of developing the draft national technical regulation;- Draft national technical regulation (including both the draft text and electronic file) accompanied by copies of original documents used as a basis for drafting the national technical regulation and other reference documents;- List of organizations and individuals consulted for opinions; summary and response to feedback along with the feedback documents;- Other documents and materials;- Verification record of the draft national technical regulation by the Ministry of Industry and Trade and related documents;- Document responding to the verification comments;- Official Dispatch requesting appraisal.

3. Appraisal Dossier at the Legal Department

- Documents stipulated for the appraisal dossier at the Ministry of Science and Technology;- Appraisal results from the Ministry of Science and Technology;- Document responding to the appraisal comments;- Draft Circular, draft submission to the Minister of Industry and Trade for promulgation of the national technical regulation.

Additionally, this Circular also regulates the registration of national technical regulations. The Ministry of Industry and Trade shall register the national technical regulations at the Ministry of Science and Technology no later than 15 (fifteen) days from the date of promulgation of the technical regulation. The registration dossier for the national technical regulation includes:

- Registration form for the national technical regulation as per Appendix IX issued with this Circular;- Copy of the national technical regulation;- Circular promulgating the national technical regulation.
