Regulations on Resolving Resignation Policies for Public Employees Transferring Jobs

This is a notable provision that public employees need to pay attention to as stipulated in Circular 03/2019/TT-BNV, which amends and supplements certain regulations on the recruitment of officials and public employees, the promotion of official ranks, the promotion of professional titles for public employees, and the implementation of contract policies for certain types of work in State administrative agencies and public service providers.

In the case of a public employee being transferred to another agency or unit, the termination of the contract and the resolution of policies are regulated as follows:

- When a public employee is transferred to another agency or unit, they must terminate their working contract with the current public service provider and be resolved in accordance with the policies and laws.

- In case the public employee is approved to be transferred to another public service provider by the competent authority, there will be no new recruitment and no resolution of termination policies.

The termination of the working contract must be documented in writing with the confirmation of the public employee and the head of the public service provider or the competent authority signing the working contract.
