Regarding this matter, LawNet would like to answer as follows: 

On May 3, 2024, the Minister of Education and Training issued Decision 1302/QD-BGDDT on the announcement of administrative procedures that have been amended and supplemented in the field of Education within the national education system under the management of the Ministry of Education and Training of Vietnam.

Procedures for awarding the "People's Teacher" title in Vietnam from May 25, 2024

* Collecting confidence votes

- The head, Director of the university, academy, Principal, and equivalent positions of the unit shall organize and implement guidance documents regarding the award of the titles “People's Teacher” and “Teacher of Merit” to officials, public employees, and workers in the unit (including teachers, education management staff at educational institutions, education management staff at education management agencies, retired education researchers receiving social insurance benefits between two successive award periods); summarize the list and dossiers of individuals proposed for the titles “People's Teacher” and “Teacher of Merit.”

- Organize the collection of confidence votes for individuals proposed for the titles “People's Teacher” and “Teacher of Merit.”

The head, Director of the university, academy, Principal, and equivalent positions convene a meeting of all officials, public employees, and workers with contracts of 12 months or more in the unit. A meeting is considered valid when at least 3/4 of the total number of officials, public employees, and workers attend. The head of the unit announces the achievements of each individual proposed for the title, organizes discussions, and collects confidence votes by ballot. The results of the confidence vote are publicly announced;

For units with 500 or more officials and workers, the head, director of the university, academy, principal, and equivalent positions organize a meeting to collect confidence votes. A meeting is considered valid when at least 300 officials and workers attend. The head, director of the university, academy, principal, and equivalent positions decide the form of confidence voting for the officials and workers who do not attend the meeting;

Individuals achieving 80% or more of the confidence votes are included in the selection list of the grassroots councils of the units under the ministry, provincial departments, the Vietnam Education Trade Union, national universities, private higher education institutions, private vocational education institutions, or the Emulation - Commendation Councils of the units, education institutions under the district management, the Emulation - Commendation Councils of the units, education institutions under the provincial departments.

* Sequence and procedures for award at councils of various levels

- The secretarial team reviews and summarizes the achievements proposed for the titles “People's Teacher” and “Teacher of Merit” according to Form No. 04; reports to the Chairman of the Council to announce the list of individuals, positions, and work units proposed for the titles by publicly posting or publishing on the website of the unit for 07 working days to collect public opinions. The State-level Council publishes the list of individuals, positions, and work units proposed for the titles on the portals of the Ministry of Education and Training of Vietnam and the Government of Vietnam for 10 working days to collect public opinions.

- The secretarial team consolidates the results of the dossier review, public posting of the proposed list, sends the documents and dossiers to the Council members, and organizes the Council meeting.

- The Council verifies the accuracy and validity of the dossiers; assesses the standards of individuals proposed for the titles.

- The Council meets, discusses, and conducts a ballot to select individuals who meet the standards for the titles “People's Teacher” and “Teacher of Merit.”

- The subordinate councils complete 01 set of paper documents as prescribed and submit it to the higher-level Council.

- The State-level Council completes the dossier and submits it to the Prime Minister of the Government of Vietnam (through the Ministry of Home Affairs) for consideration, to be proposed to the President for decision.

More details can be found in Decision 1302/QD-BGDDT which comes into force in Vietnam from May 25, 2024.
