The following are guidelines regarding the conditions for the promotion of People's Court Judges at various levels in Vietnam.

The principles for promoting Judges of the People's Court and the authority for decision-making on the promotion and appointment of Judges of the People's Court according to Article 7 Resolution 67/2025/UBTVQH15 are as follows:
- Principles for promoting Judges of the People's Court:
+ The promotion of Judges of the People's Court is conducted through assessment for promotion; ensuring the conditions for each rank of Judges of the People's Court; based on the job position, quantity, and structural proportion of the ranks of Judges of the People's Court at each court level that is allocated and other regulations in Resolution 67/2025/UBTVQH15;
+ Ensure openness, transparency, objectivity, and compliance with the law;
+ Only assess for promotion to a higher contiguous rank than the one currently held;
+ Do not assess for promotion for Judges of the People's Court who are under disciplinary action or are under prosecution, investigation, indictment, trial, or are subject to regulations related to disciplinary action according to the regulations of the Communist Party and state law.
- Authority for decision-making on the promotion and appointment of Judges of the People's Court:
+ Based on the quantity of each rank of Judges of the People's Court assigned; conditions of each rank, the promotion of Judges of the People's Court, and other regulations of Resolution 67/2025/UBTVQH15, the head of the competent agency or unit according to management decentralization proposes the assessment for promotion and appointment of Judges of the People's Court;
+ The Chief Justice of the Supreme People's Court decides on the promotion and appointment of Judges of the People's Court.
According to Article 5 and Article 6 Resolution 67/2025/UBTVQH15, guidelines on the promotion of Judges of the People's Court are as follows:
* Promotion from Judge of the People's Court Rank 1 to Judge of the People's Court Rank 2
- A person appointed as the Chief Judge of a district-level People's Court or Chief Judge of a regional military court is assessed for promotion to Judge of the People's Court Rank 2 as stipulated in Clause 4, Article 3 Resolution 67/2025/UBTVQH15.
- A Judge of the People's Court Rank 1 is assessed for promotion to Judge of the People's Court Rank 2 if, during the 5 consecutive years prior to the year of assessment, they ensure the quality of adjudication and resolution of cases according to the regulations of the Chief Justice of the Supreme People's Court and are evaluated as having completed tasks well or better, in which at least 1 year is rated as excellently performing tasks.
- In cases specified in Clause 2, Article 5 Resolution 67/2025/UBTVQH15 where the number of qualified candidates exceeds the number and structural ratio of assigned Judges of the People's Court, the assessment for promotion is conducted in the following order:
+ Persons holding leadership and management positions: Deputy Chief Judge of the district-level People's Court, Deputy Chief Judge of the regional military court;
+ Persons with higher commendation achievements in public service; if equal, then the person with more commendation achievements during Rank 1;
+ Persons with higher emulation achievements in public service; if equal, then the person with more emulation achievements during Rank 1;
+ Female Judges of the People's Court;
+ Judges of the People's Court who are ethnic minorities;
+ Older Judges of the People's Court (calculated by date, month, year of birth);
+ Judges of the People's Court with longer service time.
If still unable to determine the person to be promoted, the Chief Justice of the Supreme People's Court will consider and decide.
* Promotion from Judge of the People's Court Rank 2 to Judge of the People's Court Rank 3
- Persons appointed as Chief Judge of a provincial-level People's Court, Chief Judge of a specialized first-instance People's Court, Chief Judge of a military regional court, or equivalent as stipulated in Clause 4, Article 4, Chairperson or equivalent positions of the Supreme People's Court stipulated in Clause 6, Article 4 Resolution 67/2025/UBTVQH15 are assessed for promotion to Judge of the People's Court Rank 3.
- Judges of the People's Court Rank 2 are assessed for promotion to Judge of the People's Court Rank 3 if, during the 5 consecutive years prior to the year of assessment, they ensure the quality of adjudication and resolution of cases according to the regulations of the Chief Justice of the Supreme People's Court and are evaluated as having completed tasks well or better, in which at least 1 year is rated as excellently performing tasks.
- In cases specified in Clause 2, Article 6 Resolution 67/2025/UBTVQH15 where the number of qualified candidates exceeds the number and structural ratio of assigned Judges of the People's Court, the assessment for promotion is conducted in the following order:
+ Persons holding leadership and management positions: Deputy Chief Judge of the provincial-level People's Court, Deputy Chief Judge of the specialized first-instance People's Court, Deputy Chief Judge of the military regional court, and equivalent;
+ Persons with higher commendation achievements in public service; if equal, then the person with more commendation achievements during Rank 2;
+ Persons with higher emulation achievements in public service; if equal, then the person with more emulation achievements during Rank 2;
+ Female Judges of the People's Court;
+ Judges of the People's Court who are ethnic minorities;
+ Older Judges of the People's Court (calculated by date, month, year of birth);
+ Judges of the People's Court with longer service time.
If still unable to determine the person to be promoted, the Chief Justice of the Supreme People's Court will consider and decide.
