Persons with working period of less than 6 months ineligible to be considered for the title "Advanced Laborer" in Vietnam as of April 15, 2024 (Internet image) 

Regarding this issue, LawNet would like to answer as follows:

On February 24, 2024, the Ministry of Home Affairs issued Circular 1/2024/TT-BNV on measures to implement the Law on Emulation and Commendation and Decree 98/2023/ND-CP detailing the implementation of a number of articles of the Law on Emulation and Commendation.

1. Persons with working period of less than 6 months ineligible to be considered for the title "Advanced Laborer" in Vietnam as of April 15, 2024

Specifically, the regulation on ineligibility to be considered to be awarding the title "Advanced Worker" or "Advanced Fighter" to individuals who have been recruited for less than 6 months is stipulated in Point d of Clause 5 of Article 1 of Circular 1/2024/TT-BNV 2024.

The review of the titles ""Advanced Laborer" and "Advanced Fighter" in some specific cases is carried out as follows:

- Individuals who participate in combat, serve in combat, or perform courageous acts to rescue people or protect state assets, resulting in injuries requiring treatment and care according to the conclusions of district-level or higher-level medical facilities, the duration of treatment and care will be counted for the consideration of the titles "Advanced Laborer" and "Advanced Fighter";

- For individuals assigned to participate in short-term training and retraining for less than 01 year, complying well with the regulations of the training and retraining facility, the study time is used to calculate the working time at agencies, organizations, and units to be considered for the titles "Advanced Laborer" and "Advanced Fighter";

In the event that an individual is sent to participate in training and retraining for 1 year or more, the time spent participating in training and retraining is counted in the time to evaluate the titles "Advanced Laborer" and "Advanced Fighter". In addition to the standards and conditions according to general regulations, during the period of participation in training and retraining, individuals must comply well with the regulations of the training facility, complete learning tasks, and achieve academic results of good or better (for training and refresher courses rated average, good, and excellent, etc.);

- For individuals who transfer jobs or are transferred or seconded to another agency, organization, or unit for a certain period of time, the titles "Advanced Laborer" and "Advanced Fighter" will be considered assessed and graded by competent agencies, organizations, and units on the level of task completion (for individuals who are officers, civil servants, and public employees) or implemented by a new agency, organization, or unit (for individuals who are not officials, civil servants, or public employees). If they worked at the old agency for 6 months or more, they must have received comments from the old agency;

2. Criteria for awarding the title "Advanced Laborer" in Vietnam

According to Article 24 of the Law on Emulation and Commendation 2022, the criteria for awarding the title "Advanced Laborer" are prescribed as follows:

(1) The “Advanced Laborer” title shall be awarded to officials, public employees, and laborers who satisfy the following criteria:

- Complete tasks from good levels or above;

- Have the spirit of self-reliance, unity, and mutual assistance and actively participate in emulation movements.

(2) The “Advanced Fighter” is for national defense soldiers, workers, officials, and public employees of the People’s Army; standing militia, mobile self-defense militia; commissioned officers, non-commissioned officers, and workers working in agencies or units of the People’s Public Security that satisfy the criteria prescribed in Clause (1).

(3) The “Advanced Laborer” title shall be awarded to workers, farmers, and laborers who are not prescribed in Clauses (1) and (2) and:

- Conduct effective labor or production and actively participate in emulation movements and social activities;

- Comply with guidelines of the CPV and policies and laws of the State in an exemplary and good manner; have ethics, healthy lifestyle, unity, and mutual assistance, and help other people in the community.

(4) Ministries, departments, and central or provincial authorities shall, within their scope of tasks and entitlements, elaborate and provide specific guidelines on the criteria for consideration for awarding "Advanced Laborer" titles or "Advanced Fighter" titles for individuals in agencies, organizations, and units under their management.

(5) The Ministry of National Defense of Vietnam shall elaborate the criteria for consideration for awarding “Advanced Fighter” titles for standing militia and mobile self-defense militia.

(6) People’s Committees of provinces shall elaborate the criteria for consideration for awarding “Advanced Laborer” titles prescribed in Clause (3).
