Circular 17/2018/TT-BLDTBXH has been issued by the Ministry of Labor, Invalids, and Social Affairs to guide the self-inspection of the implementation of labor laws by enterprises.
According to the regulations stipulated in Circular 17, the procedure for enterprises to conduct self-inspections on compliance with labor laws is carried out as follows:
- The employer establishes a self-inspection team and concurrently registers an account on the information portal to obtain self-inspection forms.- The composition of the self-inspection team includes: a representative of the employer as the team leader; team members who are labor and wage officers, occupational safety and health officers; a representative of the employees and other relevant members as decided by the employer.- The self-inspection team proceeds to compare with the current labor law regulations corresponding to each self-inspection content to analyze, compare, and conclude, suggesting remedies for non-compliant contents. The self-inspection conclusion form is posted on the information portal and updated regularly when there are changes in labor laws.- For contents that require visiting the production, business site, or the workplace of the employees, the self-inspection team will visit to examine, inspect, and if necessary, immediately address any violations.- The self-inspection records include the self-inspection form, the self-inspection conclusion, the document establishing the enterprise's self-inspection team, and documents and records arising during the self-inspection process, all of which must be kept in the enterprise's management files as a basis for monitoring, analyzing, and making policies and solutions to enhance compliance with labor laws within the enterprise.
