Notable new policies of Vietnam to be effective as of the middle of January 2025

Amendments to 4 Laws concerning investment and bidding; regulation on excerpts of cadastral maps and cadastral cartography drawings from January 15, 2025; etc., are notable policies that will be covered in this bulletin.

1. Vietnam's amendments to 4 Laws concerning investment and bidding 

On November 29, 2024, the National Assembly of Vietnam approved the Law on Amendments to the Law on Planning, the Law on Investment, the Law on Public-Private Partnership Investment, and the Law on Bidding 2024 (Law No. 57/2024/QH15).

Law No. 57/2024/QH15 amends several articles of the following laws: 

Law on Planning 2017

Law on Investment 2020

Law on Public-Private Partnership 2020;

Law on Bidding 2023

Additionally, Law No. 57/2024/QH15 also annuls Articles 39 and 40 of the Law on Capital 2024. 

Law No. 57/2024/QH15 comes into force as of January 15, 2025, excluding the following cases: 

- The implementation of BT contract paid by using land funds and BT contracts paid by using the state budget shall comply with Point b Clause 12 Article 3 of Law No. 57/2024/QH15, effective as of July 1, 2025. 

- Point a Clause 19 and Clause 20 Article 1; Clause 2 Article 2; Points b, c, and d Clause 11 Article 2 of Law No. 57/2024/QH15 come into force as of July 1, 2025. 

2. Vietnam’s regulations on excerpts of cadastral maps and cadastral cartography drawings from January 15, 2025 

On November 26, 2024, the Minister of Natural Resources and Environment of Vietnam promulgated Circular No. 26/2024/TT-BTNMT on technical regulations on cadastral cartography. 

According to the Circular, the regulations excerpts of cadastral maps and cadastral cartography are as follows:  

- Excerpts of cadastral maps or cadastral cartography drawings shall be implemented for each land parcel to display information on the space and attribute of the land parcel on the cadastral map, the cadastral cartography drawing, or the land parcel registration form for use according to Point b Clause 2 Article 8 of Decree No. 101/2024/ND-CP.

Excerpts of cadastral maps or cadastral cartography drawings shall comply with the form prescribed in Appendix 19 enclosed with Circular No. 26/2024/TT-BTNMT.

- Where excerpts of cadastral maps or cadastral cartography drawings need to display the boundaries and landmarks of areas subject to state land expropriation, land allocation, land lease, and land use right auction or the planning boundaries or work corridors (displayed on the cadastral map), display such boundaries using dashed lines and specify the names of such boundary types; in case of making excerpts of property on land, display to total area and the areas of floors, property symbols, owner names, and drawings of property on land to be excerpted. 

- Where it is needed to provide information and drawings of a land parcel or more or part of or all of cadastral map sheets, cadastral cartography drawings, or land parcel registration forms, provide them in photocopies with confirmations of providing agencies (for paper copies) and digital copies according to regulations on the provision of land information and data. 

3. List of job positions in education subject to periodic transfer in Vietnam from January 14, 2025 

On November 28, 2024, the Minister of Education and Training of Vietnam promulgated Circular No. 19/2024/TT-BGDDT on the list and time limit for periodic transfer of work positions concerning education and training under the management of local authorities. 

Specifically, the 7 positions in charge of the following tasks in education and training subject to periodic transfer are as follows:  

(1) Enrollment and training of public schools. 

(2) Allocation or targets and enrollment management of educational institutions in the national education system; allocation of post-higher education training targets and overseas training targets at agencies and units under the management of local authorities. 

(3) Appraisal and approval for training and advanced training programs of educational institutions of the national education system. 

(4) Appraisal of local educational documents, teaching documents, textbooks, tools, and other technical supplies serving teaching and research purposes. 

(5) Appraisal of establishment and operational licensing documents of educational institutions in the national education system. 

(6) Management of schemes and projects concerning education and training. 

(7) Allocation and appraisal of scientific research topics concerning education and training. 

4. Vietnam’s general standards and conditions for promotion of professional titles concerning juridical records from January 15, 2025 

On November 25, 2024, the Minister of Justice of Vietnam promulgated Circular No. 14/2024/TT-BTP on standards and conditions for the promotion of professional titles concerning juridical records.

The general standards and conditions for promotion of professional titles concerning juridical records are as follows: 

(1) Meeting the standards and conditions for registering participation in the promotion of professional titles prescribed in Clause 1 Article 32 of Decree No. 115/2020/ND-CP (amended by Clause 16 Article 1 of Decree No. 85/2023/ND-CP).

(2) Meeting the general standards of occupational ethics and standards of training and advanced training qualifications of professional titles concerning juridical records prescribed in Articles 3 and 4 of Circular No. 13/2024/TT-BTP.

(3) The National Juridical Center has job vacancies according to requests of public employees participating in the assessment for promotion; 

(4) Being appointed to participate in the assessment for promotion by competent authorities.
