Regarding this issue, LawNet would like to answer as follows:
On November 29, 2023, the Minister of National Defense issued Circular 95/2023/TT-BQP regulating the renovation of motor vehicles and specialized motorcycles under the Ministry's management.
Military vehicles include motor vehicles and specialized motorcycles.
Specifically:
- Motor vehicles include cars (including chassis cars, tractor-trailer cars, and electric cars); and trailers and semi-trailers (including trailers and semi-trailers fitted with specialized equipment).
+ Automobiles include cars, trucks, and specialized vehicles.
+ Cars are passenger cars with up to 9 seats.
+ Transport vehicles are vehicles that are designed to carry goods or are used to tow artillery or weapons.
+ Specialized vehicles are vehicles with separate structures suitable to the combat-technical features and functions of each type, including: general-use vehicles and specialized military vehicles (special vehicles).
- Specialized motorcycles include military motorcycles, construction motorcycles, loading and unloading motorcycles, and other specialized motorcycles participating in traffic according to the regulations in Appendix I issued with Circular 95/2023/TT-BQP.

Renovating a military vehicle means changing the features, system, and overall components of the vehicle. In the case of replacing a system or component with a system or component of the same type and manufacturer (same part code), it is not a renovation.
In particular, the content of renovating military vehicles under the management of the Ministry of National Defense is specifically stipulated in Article 4 and Article 5 of Circular 95/2023/TT-BQP as follows:
(1) Content of motor vehicle renovation
- Change the usability features of motor vehicles
+ Cars and trucks converted into specialized vehicles or specialized vehicles converted into other specialized vehicles;
+ Specialized vehicles converted into transport vehicles and cars;
+ Trailers, semi-trailers converted into specialized trailers, specialized semi-trailers or specialized trailers, specialized semi-trailers converted into other specialized trailers, other specialized semi-trailers;
+ Install technical equipment for motor vehicles after improvement and modernization.
- Change the original system and components with other systems and components to ensure the combat-technical features of the motor vehicle.
(2) Contents of renovating specialized motorcycles
- Change the usage features of specialized motorcycles
+ Renovate and change the features of specialized motorcycles from one type to another;
+ Install technical equipment on specialized motorcycles after improvement and modernization
- Change the original system and components with other systems and components to ensure the combat-technical features of the specialized motorcycle.
Specifically, Clause 4 of Article 8 of Circular 95/2023/TT-BQP regulate application dossiers for military vehicle renovation licenses as follows:
(1) The vehicle and motor vehicle agency, a unit under the Ministry of National Defense, is responsible for preparing a dossier to request a license to renovate military vehicles.
(2) Documents for the cases specified in Clause 1, Article 4, Clause 1, Article 5 of Circular 95/2023/TT-BQP, including: Proposal from a unit under the Ministry of National Defense requesting a license to renovate military vehicles of the unit with the renovated vehicle (Form No. 1, Appendix II issued with Circular 95/2023/TT-BQP); copy of the Decision of the Chief of General Staff on approving the configuration and combat-technical features of the vehicle after renovation; A copy of the vehicle's origin document for unregistered vehicles and a copy of the registration certificate for registered vehicles; a copy of the original document for the replacement vehicle;
(3) Documents for cases specified in Clause 2, Article 4, Clause 2, Article 5 of Circular 95/2023/TT-BQP include: a proposal from a unit under the Ministry of National Defense requesting a license to renovate military vehicles of the unit with the renovated vehicle (Form No. 1, Appendix II issued with Circular 95/2023/TT-BQP); a copy of the vehicle origin document for unregistered vehicles; a copy of the registration certificate for registered vehicles; and a copy of the origin document for replacement components.
Circular 95/2023/TT-BQP takes effect on January 15, 2024, and replaces Circular 01/2011/TT-BQP.
