Complete Healthcare Policies for Female Workers

On October 1, 2015, the Government of Vietnam issued Decree 85/2015/ND-CP detailing a number of provisions of the Labor Code regarding policies for female laborers.

Article 7 of Decree 85/2015/ND-CP provides detailed regulations on health care policies for female workers as follows:

First, during periodic health examinations, female workers are entitled to a speculum examination according to the list of specialty gynecological examinations issued by the Ministry of Health.

Second, female workers during menstruation are entitled to the following:

- 30 minutes per day, for a minimum of 3 days per month;- The break time is fully paid according to the labor contract;- Specific break times are agreed upon between the employee and the employer in accordance with actual working conditions and the needs of the female worker.

Third, female workers with children under 12 months old are entitled to the following:

- 60 minutes daily during working hours for breastfeeding, expressing milk, storing milk, and resting;- The break time is fully paid according to the labor contract.

Fourth, the employer shall establish rooms for expressing and storing breast milk suitable to the actual working conditions, the needs of female workers, and the capacity of the employer.

In addition, the state encourages employers to create conditions for female workers to express and store breast milk at the workplace when raising children older than 12 months. The break times are agreed upon between the employee and the employer.

Employers are to ensure adequate shower rooms and sanitary facilities at the workplace as prescribed by the Ministry of Health. Employers are encouraged to cooperate with labor unions to plan and implement solutions for providing regular employment for female workers, apply flexible work schedules, part-time work policies, and offer work-from-home options that align with the legitimate aspirations of female employees.
