Application for Certificates of eligibility for providing antique assessment services in Vietnam as of March 15, 2024 (Internet image) 

Regarding this issue, LawNet would like to answer as follows:

On March 15, 2024, the Government issued Decree 31/2024/ND-CP, amending Decree 01/2012/ND-CP, Decree 61/2016/ND-CP, and Decree 36/2019/ND-CP.

Application for Certificates of eligibility for providing antique assessment services in Vietnam as of March 15, 2024

Specifically, the application for Certificates of eligibility for providing antique assessment services as of March 15, 2024 includes:

- Application according to Form No. 01 in the Appendix issued with Decree 31/2024/ND-CP;

- List with scientific curriculum vitae according to Form No. 02 in the Appendix issued with Decree 61/2016/ND-CP and copies of diplomas and certificates of experts;

- Copy of the recruitment decision or labor contract between the antique assessment facility and the experts;

- List of equipment and means to carry out inspection.

In particular, antique assessment facilities submit directly, by post, or electronically, 01 set of documents to the competent person specified in Article 5 of Decree 61/2016/ND-CP; specifically, the Director of the Department of Culture, Sports, and Tourism, or the Director of the Department of Culture and Sports, has the authority to issue, reissue, and revoke Certificates of Eligibility for providing antique assessment services for inspection business establishments headquartered in the area.

Previously, the application for Certificates of eligibility for providing antique assessment services would includes:

- Application according to Form No. 01 in the Appendix issued with Decree 61/2016/ND-CP;

- Copy of establishment decision, enterprise registration certificate, or legally valid business registration certificate;

- List attached with scientific curriculum vitae according to Form No. 02 in the Appendix issued with Decree 61/2016/ND-CP and copies of diplomas and certificates of experts;

- Copy of the recruitment decision or labor contract between the antique assessment facility and the experts;

- List of equipment and means to carry out inspection;

- List of sources of documents on antiques to serve appraisal activities.

Cases of revocation Certificates of eligibility for providing antique assessment services in Vietnam

According to Clause 1 of Article 8 of Decree 61/2016/ND-CP, certificates of eligibility for providing antique assessment services are revoked in the following cases:

- Antique assessment facility no longer meets the conditions specified in Decree 61/2016/ND-CP;

- Antique assessment facility dissolves or self-terminates antique assessment activity;

- Antique assessment facility has violated the law in antique assessment activity and is requested by a competent state agency to revoke the Certificate of eligibility for antique assessment activity in accordance with the law on handling administrative violations;

- Other cases of revocation as prescribed by law.

Conditions for providing antique assessment services in Vietnam in 2024

Antique assessment facilities must ensure the following conditions:

- Having a warehouse to store and preserve appraisal artifacts.

- Having equipment and means to carry out inspections appropriate to the registered field.

- Having sources of documents about antiques for reference, serving antique assessment activities.

- Having at least 03 antique assessment experts in specialized fields, according to the guidance of the Ministry of Culture, Sports, and Tourism.

Antique assessment is an activity carried out by a competent organization according to the provisions of the law on cultural heritage to determine the age, historical, cultural, scientific, aesthetic value, and other scientific issues related to the artifacts being examined.
