03 Conditions for Officials to Extend Their Retirement Age

Officials shall retire upon reaching the retirement age as prescribed by law. However, in certain cases as stipulated by law, officials may have their retirement age extended.

Officials who wish to extend their retirement age must meet 03 conditions as follows:

1. Belong to the group eligible for extended retirement age

According to the provisions in Article 2 of Decree 53/2015/ND-CP and Article 1 of Decree 104/2020/ND-CP, officials are eligible for extended retirement age if they belong to one of the following groups:

- Female officials holding the following positions and titles:

- Deputy Head of Central Committees of the Communist Party;- Deputy Chief of the Office of the Central Committee of the Communist Party;- Deputy Chairman of the Central Inspection Committee of the Communist Party;- Deputy Chairman of the Office of the President;- Deputy Chairman of the Office of the National Assembly;- Full-time Deputy Chairman of the Ethnic Council of the National Assembly;- Full-time Deputy Chairmen of the committees of the National Assembly;- Deputy Ministers;- Deputies of the heads of agencies equivalent to ministries;- Heads of agencies under the Government of Vietnam;- Full-time Deputy Chairmen of the Central Committee of the Vietnam Fatherland Front;- Deputy heads of central political-social organizations;- Deputy Directors of the Ho Chi Minh National Academy of Politics;- Deputy Editors-in-Chief of the People's Newspaper, Deputy Editors-in-Chief of the Communist Review;- Directors of the National Political Publishing House - Truth;- Officers in the armed forces holding the rank of general;- Deputy Secretaries of provincial and city party committees;- Chairmen of the People's Councils, Chairmen of the People's Committees of provinces and centrally-run cities;- Full-time Deputy Chairmen of the People's Council, Deputy Chairmen of the People's Committee of Hanoi and Ho Chi Minh City;- Members of the Standing Committee cum heads of party departments of the Party Committee of Hanoi and Ho Chi Minh City.- Members of the Standing Committee of provincial and city party committees who are ethnic minorities.

- Persons appointed to the positions and titles of Justices of the Supreme People's Court, and Procurators of the Supreme People's Procuracy.

Thus, the first condition for officials wishing to extend their retirement age is to hold one of the positions and titles permitted by law for extended retirement. For female officials, there are 21 positions that allow for extended retirement. For the positions of Justices of the Supreme People's Court and Procurators of the Supreme People's Procuracy, both male and female officials are applicable.

2. In good health

According to Clause 1, Article 4 of Decree 53/2015/ND-CP, officials wishing to extend their retirement age must ensure they have sufficient health to perform their duties and responsibilities.

This condition is appropriate since the retirement age of officials specifically and workers generally is determined based on the health factor of the worker. At a certain age, the health of the worker will decline, necessitating rest. However, the health status of each individual in different conditions and periods will change. Therefore, if officials still have sufficient health to perform their duties and responsibilities, they may be allowed to extend their retirement age.

3. Not under disciplinary action, investigation, prosecution, trial, or disciplinary execution in terms of party or government

Clause 1, Article 4 of Decree 53/2015/ND-CP stipulates that officials wishing to extend their retirement age must also meet the condition of not being under disciplinary consideration, investigation, prosecution, trial, or disciplinary execution in terms of the party or government.

Therefore, officials wishing to extend their retirement age must, besides having good health to perform their tasks, also effectively fulfill their duties during their tenure. Meeting this condition demonstrates the qualities and capabilities of the officials, which is an important criterion for considering whether to continue entrusting them with their responsibilities.
