Mid-Autumn Festival occurs annually on the 15th day of the 8th month of the Lunar calendar. This is one of the major and important traditional festivals of the Vietnamese people.

Since the Lunar calendar does not align perfectly with the Gregorian calendar, the date of Mid-Autumn Festival changes each year.

According to Article 112 of the Labor Code 2019 on holidays:

Holidays

1. Employees are entitled to fully paid days off during the following public holidays and Tet:

a) New Year's Day: 01 day (January 01 of the Gregorian calendar);

b) Lunar New Year: 05 days;

c) Victory Day: 01 day (April 30 of the Gregorian calendar);

d) International Labor Day: 01 day (May 01 of the Gregorian calendar);

dd) National Day: 02 days (September 02 of the Gregorian calendar and one adjacent day before or after);

e) Hung Kings' Commemoration Day: 01 day (March 10 of the Lunar calendar).

2. Foreign employees working in Vietnam are also entitled to an additional 01 traditional New Year holiday and 01 Independence Day of their country.

3. Annually, based on actual conditions, the Prime Minister of the Government of Vietnam decides the specific days off stipulated in points b and dd of Clause 1 of this Article.

Currently, there are no specific regulations regarding giving students a day off on Mid-Autumn Festival. However, students usually follow the schedule set by the teachers.

Mid-Autumn Festival is not among the holidays for which teachers get a day off. Therefore, students will still attend school on September 17 (Mid-Autumn Festival 2024) if they have scheduled classes that day.

When are students in Vietnam considered children?

According to Article 1 of the Children Law 2016, children are individuals under 16 years old.

Based on the provisions in Article 28 of the Education Law 2019:

Educational levels and ages in general education

1. The educational levels and ages in general education are defined as follows:

a) Primary education consists of 05 grades, from Grade 1 to Grade 5. Students start Grade 1 at 06 years old, calculated on an annual basis;

b) Lower secondary education consists of 04 grades, from Grade 6 to Grade 9. Students enter Grade 6 after completing primary education. Students start Grade 6 at 11 years old, calculated on an annual basis;

c) Upper secondary education consists of 03 grades, from Grade 10 to Grade 12. Students must have a lower secondary school diploma to enter Grade 10. Students start Grade 10 at 15 years old, calculated on an annual basis.

2. Exceptions for advancing grades, studying at higher ages than stipulated in Clause 1 of this Article include:

a) Students advancing grades in cases of early intellectual development;

b) Students studying at higher ages than stipulated in cases like repeating a grade, residing in economically and socially deprived areas, being ethnic minorities, being disabled, being underdeveloped in terms of physical or mental capabilities, being orphans, belonging to poor households, returning from abroad, and other cases defined by law.

Students are considered children if they are from Grade 11 or below.

Note: excluding cases where students repeat a grade or start school earlier/later than the designated age.
