According to Chapter III of Decree 14/2016/ND-CP on exemption from conscription in wartime, Article 7 of Decree 14/2016/ND-CP stipulates that citizens who are working in public non-business units and state-owned enterprises in the following positions are exempt from conscription:
- Citizens working in public non-business units, state-owned enterprises in border communes, islands, remote areas, and ethnic minority areas are identified with special difficulties.
According to the Prime Minister's Decision:
+ People working in the following industries: Education, Health, Postal, Telecommunications, Natural Resources and Environment, Agriculture, Forestry, Fisheries, Electricity, Coal, Petroleum, Gas, Petrol, Chemical ;
+ People who are working on roads, construction works, in charge of techniques for planting, exploiting, and processing rubber, coffee, industrial plants, and exploiting and processing forest and aquatic products.
- Citizens working in public non-business units, state-owned enterprises in other localities
Education Department:
Directors, Deputy Directors, Principals, Vice Principals: Institutes, universities, colleges, intermediate schools, vocational education centers, vocational education centers - continuing education and equivalent; Principals of high schools, junior high schools, elementary schools, preschools;
Deans of higher education institutions;
Persons holding the title of professor, associate professor, doctorate degree, title of excellent teacher, people's teacher, senior lecturer, excellent teacher at provincial or higher level in educational institutions;
Fifty percent of lecturers and teachers in educational institutions.
+ Health sector:
Directors, Deputy Directors, Heads of Hospitals at central, regional, and provincial levels and equivalent positions; Director of district hospitals and equivalent positions;
Person with the title of people's physician;
Eighty percent of people work in Central Hospitals and Institutes; seventy percent of people work in provincial hospitals; sixty percent of people work in district hospitals; and the like are not included in the plan to supplement the Army's standing force when there is a mobilization order.
+ Diplomacy:
Heads of representative missions of the Socialist Republic of Vietnam abroad;
Head of government and ministerial-level negotiating teams; Head of the Anti-Dumping Investigation Team participating in negotiation or investigation.
+ Sector of Natural Resources and Environment:
General Director, Deputy General Director, and equivalent positions under the National Hydrometeorological Center; Directors and equivalent positions of centers, federations, and radio stations under the National Hydrometeorological Center; Head of the station of meteorology, hydrology, oceanography, environment, radar, and satellite navigation;
Federation Heads, Deputy Heads, and Heads of Federations and Delegations: Geology, Planning, and Investigation of Water Resources; Directors and equivalent positions of National Federations of Water Resources Planning and Investigation; Director and equivalent positions of Federations under the National Center for Water Resources Planning and Investigation.
+ Transportation sector:
Director of international seaports; Airport Director;
The captain, first officer, and flight attendant of the Vietnam National Airlines are not included in the plan to supplement the standing force of the Army when there is a mobilization order; the head of the technical department of the airport; the head of the aircraft engineering company and a member company of the Vietnam Airlines Corporation; the director and deputy director of the Flight Operations Center;
The head of the national railway transport management agency, urban railway;
Person in charge of production and repair lines of defense products;
Captains, main helmsmen, master mechanics, and master electricians of ships: Water transport and tourism with a capacity of 1960 CV or more, pilot ships, dredgers, and rescue ships are not included in the additional plan for the Army's standing force when there is a mobilization order;
The main driver and main mechanic of the canoe at the ferry terminals are not part of the additional plan for the Army's standing force when there is a mobilization order;
Fifty percent of people work at international seaports and airports;
The main driver of the railway transport train in operation, the train dispatcher, the train operator, the station chief of the Vietnam Railways;
Lighthouse keepers, navigators.
Postal and telecommunications sectors:
Director of the provincial telecommunications center; Director of the Provincial Information Operations Center;
Those who ensure communications in times of war;
People who work in the production and repair lines of defense products.
+ Construction sector:
Chief Engineer, Supervision Consultant of national key projects according to regulations of competent authorities;
People who make roads and build national key projects according to the regulations of competent authorities during the war.
+ Department of Culture, Information, and Communication:
Director of national and ministerial-level museums;
Head of the Central Culture and Arts Union and equivalent positions;
Main director of national cultural and artistic programs and works;
Person with the title of People's Artist;
Director of national sports centers and equivalent positions;
International refereeing of sports;
Head coaches, athletes of national teams are in the process of preparing for and participating in international competitions.
+ Industries: Electricity, Coal, Petroleum, Gas, Petroleum, Chemicals:
Those who worked in the production and repair lines of defense products during the war;
Persons in charge of operating and repairing furnaces and machines at power generation plants; the person in charge of the division of operation and repair of lines and transformer stations of high-voltage systems of electricity distribution and transmission establishments;
Fifty percent of petrochemical engineers in businesses.
+ People working in the field of scientific research:
Director, Deputy Director of Institute of Scientific Research, Director, and equivalent positions of: scientific research centers, laboratories, stations, research camps, monitoring stations, and testing stations under the Government and ministries and branches;
Heads of research projects at ministerial, branch, national, and international levels;
People with doctoral degrees who are conducting scientific research on topics at ministerial, branch, national, or international levels;
Persons with master's degrees or principal researchers or higher who are conducting research in national and international scientific works;
A person with the rank of professor or associate professor who is conducting scientific research.
+ People who are directly drawing, printing, or minting money;
+ People working in the cipher sector;
+ Mechanical sector, dynamics: those who work in the production and repair lines of defense products;
+ Chairman of the Members' Council or Chairman of the Board of Directors, Director or General Director, Chief Accountant of enterprises with 350 employees or more or enterprises with 150 to less than 350 employees but has a great impact on the economic activities of a region or an economic field of the country; Chairman of the Members' Council or Chairman of the Board of Directors, General Director or Director, Deputy Director of enterprises with 700 employees or more; Deputy Director, Chief Inspector, Head of Department, and equivalent positions of enterprises with 1,400 employees or more;
Persons with vocational skills level 5 or equivalent or higher belong to enterprises with 350 employees or more.
According to Article 9 of Decree 14/2016/ND-CP, the confirmation of the number of citizens currently working at agencies or organizations and serving in the People's Army for citizens exempt from military service in Vietnam shall be carried out as follows:
- Every year, the heads of enterprises specified at Point o, Clause 2, Article 7 of Decree 14/2016/ND-CP report the number of citizens working at the enterprise to the Hanoi Capital Command, Ho Chi Minh City Command, Military Commands of provinces, and centrally run cities (hereinafter collectively referred to as Provincial Military Commands) where the enterprise's head office is located; The provincial-level Military Command shall assume the prime responsibility for, and coordinate with relevant agencies in, appraisal, and the provincial-level People's Committee chairperson shall certify.
- The district-level military command board certifies the percentage of citizens exempt from conscription for agencies and organizations, where the agency or organization is headquartered.
- Citizens who are exempt from conscription, if they have a volunteer application to serve in the People's Army and get the consent of the head of the agency or organization that manages and employs such citizens, may be called up for military service.
