Circular 162: Guidelines on Special Allowance Policies for the Guard Force

Recently, the Ministry of National Defense issued Circular 162/2018/TT-BQP guiding the special allowance policies for the Guard Force under the Ministry of National Defense.

The following subjects are entitled to receive one of the four special allowances rates, including: 30%, 25%, 20%, and 15% calculated on the rank salary level for officers or type, group, tier for professional officers:

- Officers, professional soldiers assigned to the Protection Department of the Military Security Protection Agency, General Department of Politics;- Officers, professional soldiers who are assigned to work according to the titles stipulated at the Protection Department of the Military Security Protection Agency, General Department of Politics for a period of 01 month or more.

The special allowance rate is calculated according to the following formula:

Special Allowance Rate = Military Rank Salary Coefficient or Type, Group, Tier X Statutory Pay Rate X % Special Allowance Rate

Where: The statutory pay rate is implemented according to regulations of the Government of Vietnam at each specific time.

Note:

- The above-mentioned special allowance is paid together with the monthly salary and is not used to calculate, contribute to, or benefit from social insurance and health insurance benefits.

- Officers, professional protection soldiers eligible for which special allowance rate shall receive that specified rate. In cases where subjects qualify for multiple special allowance rates, only the highest rate is applied.

- The aforementioned subjects are not entitled to the special allowance in the following cases:

- When there is a decision to retire (pre-retire), transfer to another sector, demobilize, discharge or transfer, transfer to an agency or unit that does not perform protection duty, the special allowance ceases to be effective from the month immediately following the month of the decision;- Continuous going on business trips, studying, and working abroad for 30 days or more;- Full-time study in domestic and overseas training facilities for 03 months or more;- Sick leave, maternity leave exceeding the period stipulated by the Law on Social Insurance;- Suspension from work.
