On November 30, 2022, the Minister of Health of Vietnam issued Circular 13/2022/TT-BYT on the forensic examination process, form, time limit, and human resources to conduct forensic examination.
In particular, the time limit for forensic examination in Vietnam is stipulated as follows:
- For cases requiring expert consultation, they must be handled in accordance with the provisions of the Criminal Procedure Code 2015.
- For other cases, they must be handled as follows:
(1) No more than nine days for assessment cases of sexual abuse, abuse, sex determination, pregnancy, and male sexual ability, and no more than eighteen days for consultation cases.
(2) No more than 20 days for toxicology, histopathology, and DNA, and no more than 1 month for consultations;
(3) For cases not falling into (1) or (2) above, the time limit for expertise shall comply with the provisions of Clause 3 and Article 26a of the Law on Judicial Assessment 2012 (amended in 2020).
Vietnam's Circular 13/2022/TT-BYT takes effect on March 1, 2023, replacing Vietnam's Circular 47/2013/TT-BYT.
