Vietnam: The host authority in the formulation of legislative documents on elaboration of the Land Law 2024

The host authority in the formulation of legislative documents on elaboration of the Land Law 2024 in Vietnam

Assignment of host authority and coordinating units in the formulation of legislative documents on land in Vietnam as follows:

(1) Assignment of host authority:

- The Land Department will lead, in cooperation with related units, the formulation of 02 Decrees.

- The Legal Department will lead, in cooperation with related units, the formulation of 01 Decree.

- The Department of Planning and Development of Land Resources will lead, in cooperation with related units, the formulation of 02 Decrees and 07 Circulars under the authority of the Minister of Natural Resources and Environment in Vietnam.

- The Department of Land Registration and Data Information will lead, in cooperation with related units, the formulation of 01 Decree and 10 Circulars under the authority of the Minister of Natural Resources and Environment.

(2) Assignment of coordinating units in the formulation of regulations and guidelines for the implementation of the Land Law led by other Ministries and Departments:

- The Land Department will lead, in cooperation with related units, the research and feedback on the draft Decree detailing regulations on rice cultivation land led by the Ministry of Agriculture and Rural Development.

- The Department of Planning and Development of Land Resources will lead, in cooperation with related units, the research and feedback on the draft Decree on the land development fund, the draft Decree on land levy, land rent led by the Ministry of Finance, and the draft Decision of the Prime Minister of the Government of Vietnam on the mechanism and policies for job creation and vocational training for those whose land is acquired led by the Ministry of Labor, Invalids, and Social Affairs.

- The Department of Land Registration and Data Information will lead, in cooperation with related units, the research and feedback on the draft Circular governing the levels of collection, policies, collection, payment, management, and use of fees for the exploitation and use of land documents led by the Ministry of Finance; the draft Circular on the preparation and management of administrative boundary dossiers led by the Ministry of Home Affairs.
