Government issued Decree 129/2022/ND-CP dated December 30, 2022 on Vietnam's special preferential import tariff schedule to implement the Regional Comprehensive Economic Partnership Agreement for the period 2022-2027.
According to Vietnam's Decree 129/2022/ND-CP, Vietnam's special preferential import tariffs for the implementation of the Regional Comprehensive Economic Partnership Agreement for the period 2022–2027 (RCEP tax rates), include:
- Appendix A: Special preferential import tariffs for ASEAN countries as prescribed in Clause 2, Article 4 and Article 5 of Vietnam's Decree 129/2022/ND-CP;
- Appendix B: Special preferential import tariffs for Australia;
- Appendix C: Special preferential import tariffs for China;
- Appendix D: Special preferential import tariffs for Japan;
- Appendix E: Special preferential import tariffs for Korea;
- Appendix F: Special Preferential Import tariffs for New Zealand.
In addition, imported goods subject to the RCEP tax rate must fully satisfy the following conditions:
- Belong to the Special Preferential Import Tariff promulgated together with Vietnam's Decree 129/2022/ND-CP, specifically:
- Imported from countries that are members of the RCEP Agreement, including the following countries and territories:
+ Brunei Darussalam;
+ Kingdom of Cambodia;
+ Republic of Indonesia;
+ Lao People's Democratic Republic;
+ Malaysia;
+ Republic of Singapore;
+ Kingdom of Thailand;
+ Australia;
+ People's Republic of China (China);
+ Republic of Korea (Korea);
+ Japan;
+ New Zealand.
- Comply with the origin of goods regulations (including direct transport regulations) and have proof of origin of goods in accordance with the provisions of the RCEP Agreement and current legal regulations.
Vietnam's Decree 129/2022/ND-CP takes effect from December 30, 2022.
