Vietnam’s new National Technical Regulation on safety and environmental protection for construction machinery 

Specifically, the National Technical Regulation on safety and environmental protection for construction machinery (QCVN 13:2023/BGTVT) is enclosed with Circular No. 45/2023/TT-BGTVT

- Scope

QCVN 13:2023/BGTVT provides for the technical safety and environmental protection of construction machinery in the manufacturing, assembly, import, renovation, and utilization of items included in the list of potentially unsafe commodities enclosed with Circular No. 12/2022/TT-BGTVT.

- Regulated entities

+ QCVN 13:2023/BGTVT applies to manufacturing and assembly facilities; importers and owners of construction machinery; organizations and individuals involved in the management, inspection, experiment, and certification of technical safety and environmental protection of construction machinery. 

+ QCVN 13:2023/BGTVT does not apply to the construction machinery of the Ministry of Public Security of Vietnam and the Ministry of National Defense of Vietnam used for national defense and security. 

See more details in Circular No. 45/2023/TT-BGTVT, which comes into force as of July 1, 2024 and annuls Clause 5 Article 1 of Circular No. 56/2011/TT-BGTVT.

Attention:

- Certificates of technical safety and environmental protection of construction machinery, factory release notes, or renovation testing records issued under QCVN 13:2011/BGTVT shall continue to be used until they expire;

- Construction machinery imported to Vietnam before July 1, 2024 shall comply with QCVN 13:2011/BGTVT.
