Vietnam's guidelines on repair and maintenance of dykes and emergency handling of dyke incidents

On December 21, 2023, the Minister of Agriculture and Rural Development of Vietnam promulgated Circular No. 25/2023/TT-BNNPTNT guiding the repair and maintenance of dykes and emergency (urgent) handling of incidents concerning dykes.

According to the Circular, the procedure for formulating plans to repair and maintain dykes with funding from the central budget shall be carried out as follows: 

- Grounds to formulate plans: 

+ The urgency to repair and maintain to ensure dyke safety, prevent deterioration, and meet the requirements for flood and storm prevention and management;

+ The current condition of dykes and the level of damage and deterioration; 

+ Dyke management requirements and tasks; 

+ Technical standards, technical regulations, technical-economic norms, and relevant cost, price, and unit price norms.

-  Departments of Agriculture and Rural Development shall organize the formulation of plans to repair and maintain dykes before June 15 every year and send them to the Vietnam Disaster and Dyke Management Authority for inspection and summary. 

- Documents in a plan include: 

+ Statement of the Department of Agriculture and Rural Development of Vietnam enclosed with the summary table of plans to repair and maintain dykes following the form in Appendix I enclosed with Circular No. 25/2023/TT-BNNPTNT;

+ Reports on plans, including a presentation of the current condition of dykes (enclosed with images if any) and the necessity for dyke maintenance and repair, the proposal for technical or preliminary solutions to the main implementation (expected), and the budget for the repair and maintenance of dykes by each item and dyke line; Representative cross-sectional drawings.

-  Vietnam Disaster and Dyke Management Authority shall:

+ Formulate the contents of tasks and budget for the repair and maintenance of dykes to be implemented by the Authority; 

+ Summarize and formulate plans to repair and maintain dykes, including contents of local plans according to Clause 2 Article 3 and contents prescribed in Point a Clause 3 Article 3 of Circular No. 25/2023/TT-BNNPTNT;

+ Present the above to the Ministry of Agriculture and Rural Development of Vietnam before July 5 for submission to the Ministry of Finance of Vietnam for summary for appeal to competent authorities as per regulation.
