On December 31, 2020, the Government of Vietnam issued the Decree No. 154/2020/NĐ-CP amending the Decree No. 34/2016/NĐ-CP guiding the Law on Promulgation of Legislative Documents.
Decree No. 154/2020/NĐ-CP supplements the provision that the Resolution on programs, schemes, projects and plans issued by the People's Council is not a legislative document.
Thus, from January 01, 2021, there are 09 cases of Resolutions promulgated by the People’s Councils are not legislative documents:
1. Resolutions relieving from duty or removing from office People’s Council deputies or holders of other posts;
2. Resolutions approving results of election of deputies to People’s Councils and election of other posts;
3. Resolutions dissolving People’s Councils;
4. Resolutions approving the structures of specialized agencies under People’s Committees of provinces, centrally run cities, rural districts, urban districts, towns or provincial or municipal cities;
5. Resolutions on the establishment, merger or dissolution of specialized agencies under People’s Committees; decisions on the establishment of boards, steering boards, councils or committees to perform tasks within a certain period of time;
6. Resolutions on total payrolls in localities;
7. Resolutions on local budget estimates and final accounts;
8. Resolution on programs, schemes, projects and plans;
9. Other resolutions and decisions which do not have the contents prescribed in Article 27, 28, 29 and 30 of the Law on Promulgation of Legislative Documents 2015 of Vietnam.
