Vietnam: Formulation of 04 legislative documents on elaboration of the Law on Management and Protection of National Defence Structures and Military Areas

Law on Management and Protection of National Defence Structures and Military Areas was adopted by the XV National Assembly of Vietnam at the 6th session on November 24, 2023, and will take effect from January 1, 2025.

Formulation of 04 legislative documents on elaboration of the Law on Management and Protection of National Defence Structures and Military Areas

The formulation of detailed regulations and measures for the implementation of the Law on Management and Protection of National Defence Structures and Military is specified as follows:

(1) Formulate a Decree on the classification, grouping, and determination of the protection scope for national defense projects and military zones.

- Host: Ministry of National Defense.

- Coordinating agencies: Ministry of Justice, other ministries, central authorities, and relevant agencies.

- Deadline for submission to the Government of Vietnam: Before October 15, 2024.

(2) Formulate a Decree detailing certain provisions of the Law on Management and Protection of National Defence Structures and Military Areas.

- Host: Ministry of National Defense.

- Coordinating agencies: Ministry of Justice, other ministries, central authorities, and relevant agencies.

- Deadline for submission to the Government of Vietnam: Before October 15, 2024.

(3) Formulate Decisions by the Prime Minister of Vietnam on the management and protection of national defense projects and military zones classified as Special Groups according to the Law's provisions.

- Host: Ministry of National Defense.

- Coordinating agencies: Ministry of Justice, relevant ministries, central authorities, and local governments.

- Deadline for submission to the Prime Minister of Vietnam of the Government of Vietnam: Before October 15, 2024.

(4) Formulate a Circular by the Ministry of National Defense detailing the implementation of certain provisions of the Law on Management and Protection of National Defence Structures and Military Areas.

- Host: Ministry of National Defense.

- Coordinating agencies: Relevant ministries, central authorities, and agencies.

- Issuance deadline: Before November 15, 2024.

** Organization for monitoring, inspection, and reporting on the implementation of the Law

- Host: Ministry of National Defense.

- Coordinating agencies: Ministries, central agencies, agencies under the Government of Vietnam, People's Committees of provinces and centrally-run cities.

- Implementation period: Periodically and upon request.
