Vietnam: Amendment to the eligibility conditions for applying the special preferential import tariff rates under the VN-EAEU FTA Agreement

This is the content of Decree 113/2022/ND-CP dated December 30, 2022, promulgating Vietnam’s special preferential import tariff schedule for implementation of the Free Trade Agreement between the Socialist Republic of Vietnam, of the one part, and the Eurasian Economic Union and its Member States, of the other part, in 2022 – 2027 period.

Eligibility conditions for applying the special preferential import tariff rates under the VN-EAEU FTA Agreement in Vietnam are as follows:

1. They are included in the special preferential import tariff schedule enclosed herewith.

2. They are imported from member states of the VN-EAEU FTA Agreement, including:

- Republic of Armenia;

- Republic of Belarus;

- Republic of Kazakhstan;

- Kyrgyz Republic;

- Russian Federation.

3. They meet origin criteria (including provisions on direct consignment) and are supported by proofs of origin as prescribed in the VN-EAEU FTA Agreement and regulations in force.

(Compared to before in Decree 150/2017/ND-CP, the condition that imports must be directly transported from exporting countries as stipulated in Clause 2 Article 4 herein by the Ministry of Industry and Trade has been annulled.)

Decree 113/2022/ND-CP takes effect from December 30, 2022 and replaces Decree 150/2017/ND-CP.
