Amending certain regulations on management and use of seals of Decree 99

Decree No. 56/2023/NĐ-CP of Vietnam’s Government amends certain regulations on management and use of seals of Decree No. 99/2016/NĐ-CP. In particular:

(1) New regulation on forms of submission of application for settlement of seal-related procedures

Every agency, organization or title of the state shall submit an application for settlement of seal-related procedures specified in Articles 13, 14, 14, 16 and 17 of Decree No. 99/2016/NĐ-CP to the seal sample registration authority specified in Article 12 of Decree No. 99/2016/NĐ-CP by adopting any of the following methods:

- In person at the application receiving department of the seal sample registration authority;

- Using the public postal service;

- Through the National Public Service Portal or Public Service Portal of the Ministry of Public Security (except for the documents not permitted to be posted online as prescribed by law).

(Currently, dossier shall be submitted directly at the reception department of the seal sample registration body or via the website of the seal sample registration body (except the documents and papers which must not be published via the network in accordance with the law))

(2) New regulation on receiving and checking dossier information

The application-processing official shall inspect information and documents in the application and comply with the following provisions:

- If the application is valid, the application-processing official shall provide a confirmation slip, clearly stating the date of receipt and date of return of result, to the person who is sent by the agency, organization or title of the state to submit the application;

- If the application is inadequate, the application-processing official shall forthwith notify and instruct the agency, organization or title of the state to complete their application;

- If the application fails to meet the conditions set out by law, the sample seal registration authority shall give a written response stating its rejection of the application to the agency, organization or title of the state within the time limit specified by law.
