According to regulations, the investor in Vietnam is responsible for installing project signage at the construction site, except in the case of detached houses with a scale of less than 7 floors.

1. Conditions for commencement of construction works in Vietnam

According to Article 107 of the Construction Law 2014 (amended in 2020), the conditions for the commencement of construction works are stipulated as follows:

* The commencement of construction works must ensure the following conditions:

(1) There must be a construction site available for handing over in full or in parts according to the construction schedule;

(2) There must be a construction permit for works that require one as per the provisions of Article 89 of the Construction Law 2014 (amended in 2020):

- Construction works must have a construction permit issued by the competent state authority to the investor as per the provisions of the Construction Law 2014, except in cases stipulated in Clause 2, Article 89 of the Construction Law 2014 (amended in 2020).

- Cases exempt from construction permits include:

+ State secret works; urgent construction works;

+ Works under projects using public investment funds approved for construction by the Prime Minister of the Government of Vietnam, heads of central agencies of political organizations, the Supreme People's Procuracy, the Supreme People's Court, the State Audit Office, the Office of the President, the Office of the National Assembly, ministries, ministerial-level agencies, agencies under the Government of Vietnam, central agencies of the Vietnam Fatherland Front, and social-political organizations, or by chairpersons of the People's Committees at all levels;

+ Temporary works as stipulated in Article 131 of the Construction Law 2014 (amended in 2020);

+ Works for internal repairs or external repairs not facing roads in urban areas requiring architectural management as stipulated by competent authorities; repair content does not change usage functions, does not affect the work's structural safety, complies with approved construction plans, and meets fire, explosion, and environmental safety requirements;

+ Advertising works not subject to construction permit requirements according to advertising law; passive telecommunications infrastructure works as stipulated by the Government of Vietnam;

+ Works located in two or more provincial administrative territorial units, works constructed along lines outside urban areas meeting approved construction or technical, specialized planning;

+ Works whose construction design following the basic design has been evaluated and approved and meets construction permit conditions as per the Construction Law 2014;

+ Detached houses less than seven stories under urban area construction investment projects, or housing projects with detailed 1/500 planning approved by competent authorities;

+ Grade IV construction works, detached houses in rural areas less than seven stories in areas not covered by urban, functional area construction planning, or detailed rural residential area planning approved by competent authorities; Grade IV construction works, detached houses in mountainous, island areas not covered by urban, functional area planning; except constructions or detached houses in conservation, historical, cultural sites;

+ Investment owners of projects as defined in points b, e, g, h, and i clause 2 Article 89 of the Construction Law 2014 (amended in 2020), except detached houses defined in point i clause 2 Article 89 of the Construction Law 2014 (amended in 2020) must notify construction commencement, design documents to local construction management authorities for management.

- Construction permits include:

+ New construction permits;

+ Repair, renovation permits;

+ Relocation permits for structures;

+ Term construction permits.

- Works can be issued construction permits in stages upon having post-basic design construction designs appraised and approved as per the Construction Law 2014.

- For construction investment projects with multiple works, permits may be issued for one, some, or all works when concurrent execution is required, meeting construction permit criteria and project synchronization.

(3) Approved construction design drawings of components, works to be commenced;

(4) The investor has signed a contract with the contractor for construction-related activities of the works to be commenced as per legal regulations;

(5) Safety and environmental protection measures in place for construction;

(6) The investor has notified the local construction management authority of construction commencement at least three working days prior to starting.

* Commencement of detached houses only needs to meet the condition specified in (2) of this section.

2. Contents on signboards installed at new construction sites in Vietnam

According to clause 1, Article 109 of the Construction Law 2014, the investor is responsible for installing construction signs at the site, except for detached houses less than seven stories. The content of signs includes:

- Name, scale of the work;

- Commencement date, completion date;

- Name, address, and phone number of the investor, construction contractor, construction design organization, and construction supervision organization or individual;

- Perspective drawing of the work.

3. Management contents of construction sites in Vietnam

According to clause 2, Article 109 of the Construction Law 2014, the construction contractor is responsible for managing the entire construction site according to legal regulations, except when organized by the investor. The management contents include:

- The perimeter of the construction site must have barriers, guard posts, visible and noticeable signs to separate the construction site from the outside;

- The site layout within the construction area must be in accordance with approved construction general layout drawings and specific site conditions;

- Materials, materials, and equipment awaiting installation must be neatly arranged according to general construction layout design;

- Within the construction site, there must be signs indicating the general site layout, safety, fire, and explosion prevention, and other necessary signs.

Additionally, as per clause 3, Article 109 of the Construction Law 2014, the construction contractor must ensure safety measures for people and vehicles entering and exiting the site, as well as properly collect and dispose of construction waste, avoiding negative impacts on the surrounding environment.
