Recently, the Ministry of Public Security issued Circular 63/2020/TT-BCA stipulating the procedures for investigating and handling road traffic accidents by the Traffic Police force.
According to Circular 63/2020/TT-BCA, in cases of traffic accidents without signs of crime, the investigation, verification, and resolution time frames are as follows:
- Upon receiving a report of a traffic accident, the Traffic Police (CSGT) must conduct an investigation, verification, and resolution within 07 days; in cases of traffic accidents with many complex details requiring additional verification, the period may be extended but not beyond 30 days from the date of receiving the report of the traffic accident.
In cases where professional assessment is required or additional time is needed to verify, collect documents, and evidence, the authorized person must report in writing to their direct superior to request an extension; the extension must be in writing, and the extension period shall not exceed 30 days.
- At the end of the investigation, verification period, the Traffic Police must issue a Notice of Investigation, Verification, and Resolution Results of the Traffic Accident according to form No. 14/TNDB issued under Circular 63/2020/TT-BCA and proceed to handle according to administrative legal regulations.
